    I thought that when i sent my letters to all of my credit card companies that I wouldnt send the £10 fee for the statements as I didnt have the money to do so, the other reason is that i have read that the companies sometimes send the fee back to the claimant anyway, thought id save them and me the trouble!!

    However, I think this may backfire on me, as the letter requesting statement information gives the company 40 days to reply.

    WILL THE CREDIT CARD COMPANIES MAKE ME WAIT 40 DAYS AND THEN REQUEST THE £10 FEE FROM ME???

    what should i do??

    As every other bank company onher any response/approach is totally inconsistant (other than delay delay) I have also read that CC companies often send the cheque back or do not cash. Barclaysbank sent my daughter's cheque back but Nat west cashed mine. Cap 1 did not cash mine whereas Mothercare( GE Bank ) I did not send a cheque -wrote within 2 weeks of my 1st letter to ask for a cheque I dont think yours would playthe game of waiting 40 days to ask for a cheque

    Unfortunately, the Financial Ombudsman will only request the difference between the current £12 charge and any older and higher charges so is not an alternative to court proceedings for these claims.


    So basically there's no point contacting the FO since their argument will be supported there. Could they refer to the FO in court and win the case? My defence against this would be that a) the £12 is a recommendation, not a ruling, and b) this is the maximum (not a fixed) amount that has been recommended.

    Have recieved an offer today from HSBC for just over half the amount claimed. I telephoned the number on the letter and was told that this figure is not negotiable by phone. They said that it may be possible to negotiate offers for bank charges but not for credit card charges. Has anyone else had the same experience with HSBC.. If it goes to the court stage would I be better to accept what is being offered and claim the balance or reject the offer and claim the full amount. If anyone has negotiated their credit card charges with HSBC over the phone a telephone no that wasused would be appreciated. Thanks
  • Well I think the FO is an option for helping with the claims for credit cards BUT they said that they will only request the amount which equals the difference between the OFT ruling of £12 per item charged and the amount the claimant has been charged per item..

    The £12 charge is still excessively excessive!!!

    The FO said that they are able to claim the FULL amount of charges for Banks and Building Societies because, as yet, there has been no ruling.

    So, in my case, as some of my credit cards have already offered me a settlement of my £12 difference plus a tiny bit of interest, then the FO cant help me.. However, they did say that I could write to the credit card companies and state that they have made a slight mistake in the interest calculation and see what result I get.

    I have been offered the difference of the charges and £12 by all the credit card companies I have written to. I was going to now send it to FO, but reading the above it sounds like I will not get any more so should I just accept the offers or take it to court? Also I have been sent a cheque from MBNA - should I bank it or just keep it as it was only half of what I wanted!?!

    I know we can get the charges back from our bank accounts but can we do the same for our credit cards?????????????
    If so....... will they cancel my account. :confused:

    Yes, you can claim back credit card late payment charges.

    Even the Office of Fair Trading’s figure of £12 is still “extravagantly” higher than the cost of automatically administering a late payment and therefore unlawful. All that happens is that the computer adds the charge to your account. I didn't even get a standard letter.

    You can use the bank charge letter templates with a little bit of customisation. The banks and credit card companies will try to use the OFT ruling as justification that the charges as correct, though.

    Unfortunately, the Financial Ombudsman will only request the difference between the current £12 charge and any older and higher charges so is not an alternative to court proceedings for these claims.

    They can't cancel your account, unless you breach the contract. Therefore, if you are reclaiming charges you must do everything possible to avoid paynig late and being charged in future. The simplest way is to set up a Direct Debit for the minimum payment.
