    If there is an outstanding debt on the account you are claiming on, the bank or credit card company involved can and will offset any monies reclaimed against that debt.

    Yes.

    The Office of Fair Trading’s figure of £12 is still “extravagantly” higher than the cost of automatically administering a late payment and therefore unlawful. All that happens is that the credit card company’s computer adds the charge to your account. You don't even get a standard letter.

    However, the credit card company will try to use the OFT ruling as justification that their charges are correct.

    You can use the bank charge template letters with a little bit of customisation.

    I'm helping a friend who is in debt reclaim charges from 7 credit cards. We're at the LBA stage for most of them and their time runs out on 14th June, so looks like we'll have to go to small claims court.

    Since we sent the LBAs, she's had more charges added on (she's basically getting late payment charges on all 7 cards every month). When we fill out court forms, can we add these on? Even although they weren't put in the list of charges on the LBA?

    I am new to the site and could not work out how to start a new thread so I hope you will forgive me if I piggyback my questions on to yours.

    I don't want to reclaim the charges from my bank as I now have a very good relationship with them, and don't want to blow it for a couple of hundred pounds.

    However, in the past I have been a big credit card happy so I have about 13 credit cards that are now all paid off in full, but in the past have had charges due to late payments or going over the credit limit. As I don't use them any more I don't care if I agravate them by reclaiming charges.

    The problem is this - is there a minimum point where it is not worth trying. For example, my charges to AMEX were £112.69 even if I include the interest and Halifax is even lower at £60.19.

    I will pursue the cards that have higher charges, but does anyone know whether it is worth me trying at these low amounts?

    Hi yes you can add additional charges on up to the point of filing with MCOL/local court,

    Yes it's money thats owed to you, you've got nothing to lose by trying to reclaim them back so go for it, every little helps :D

    This is going to be a bit long winded Im afraid!!

    Just thought I'd give a little help with regards to credit cards owned and run by Royal Bank of Scotland, ie:

    Tesco Personal Finance
    Mint
    RBS
    Nat West

    The address I used to request my charges details was given to me over the telephone by one of them (not sure which one), but they are all in Southend-on-Sea: I addressed them to Fees and Charges Claims, in Southend-on-Sea, but with the following PO box numbers and postcodes:

    Tesco personal finance, po box 5747, SS1 9AJ
    Mint, po box 5747, SS1 9AJ
    RBS, po box 5636, SS99 1WJ
    Nat West, po box 5636, SS99 1WJ

    Even though the accounts were paid in full and closed a while ago, I wrote to them all requesting charges details on Thurs 24 May, (but forgot the cheque for £10), sent cheque Thurs 31 May.

    TODAY (Thurs 7 June), I received the details (cheques not cashed as yet) of the charges from my accounts, in a spreadsheet format, not happy about that aspect of it as unable to check the details for myself.

    ALL of the letters were signed by Sarah Appleford, Team Manager, Customer Care Team (shes not available by telephone but at the MINT address)

    However, along with the details was an offer of full and final settlement.
    BE AWARE that at the moment the credit cards ONLY need to offer you the difference between the £12 charge and your original charge, they also added interest (which if using the interest calculator on here works out to be more), but anyway, they have offered a settlement 2 weeks after requesting charges details.

    I THEN SPOKE TO THE F.O. and asked their advice, which they informed me of the fact that they would only request the difference between the £12 charge ruling and the original fees charged to you.
    The lady there was extremely helpful (so much so that they are writing today to my 2 Natwest bank accounts to "hurry them up" even though 8 weeks not gone by yet).

    So, all in all, even though my settlement figures for the credit cards are low, (as I was careful not to be late in payment and going over limit), and my original charges were low amounts, the lady at the FO stated that there wasnt much that they could do for me, as the credit card companies have offered what the FO would have requested.

    SO THATS 4 DOWN AND 5 MORE TO GO:
    2 bank accounts with Nat West - FO hurrying them up
    CitiCard Credit Card - still awaiting statements
    Littlewoods Barclaycard - got statements from 6/2004-waiting for the rest
    Monument Credit Card - still awaiting statements

    I dont know if this has been of any help at all to anyone, I do hope so, as I was overwhelmed with how many companies I had to deal with.

    Useful info', although it's a pity that the FO isn't an option for reclaiming the CC late payments, including the still excessive and unlawful £12 ones, in full.
