Can you claim charges from credit cards for going over the limit or missing payments etc?
Also, if you can, would I still be able to claim them. I have 4 credit cards, MBNA, Egg, Barclaycard and RBS and all of them are with debt collection agencies as I was off work sick for a long time and couldn't pay them. I have arrangements set up for all of them now and I am paying but I don't know if this will effect my ability to claim or not.
If I claim can they close my account and insist on full payment? Obviosuly I wouldn't be able to afford that so if they do that then it wouldn't really be a good idea claiming.

We wrote to Egg asking for a copy of my friend's statements, enclosing a cheque for £10. They wrote back saying they value their customers security and they want to her to send proof of ID (ie a utility bill or something). They will start counting 40 days from the day they receive this.
Is this just a delaying tactic? None of the other banks/CCCs have asked for proof of ID.
Also, CLYDESDALE wrote back within the 40 days saying they have a backlog and will take longer to send the statements. The FSA know about the backlog, but she is welcome to complain if she wants. Again, is this a delaying tactic?0 -

Hello I've just joined today and wondered if the same letters and calculators can be used when attempting to re-claim credit card charges. It seems that there is a difference between bank and credit card charges...or am I incorrect?
Appreciate some advice, as I have a Barclayard that has been withdrawn and I am paying back an agreed £10.00 per month on about £1300.00. it may not seem a lot compared to some people, but a lot of that £1300.00 includes interest on late payments and added to the bill at the end of the day.

I have a problem with natwest cc. I wrote to them with my £10 cheque in March requesting statements - i think im owed about £100. After 40 days I still hadn't heard from them, I sent a second letter 3 weeks ago & still no reply. What do I do next?
Does any one know the address or a template letter to complain to the Information Commissioner? I have had sucess in claiming £615 worth of bank charges with natwest, but they seem to be ignoring me when it come to my credit card?

Its more difficult with CC to get the statements as with a bank I'd suggest sitting on their doorstep but not to easy with the CC, however I would keep phoning them until they are sick of you.
You can claim back late payment fees and/or over limit fees, you can't claim the interest charged. Just alter the template slightly to reflect what you are claiming.
To hez1414 you can start a claim but be aware that any monies reclaimed are likely to be put towards the debt.

Sent first letter (template from this site) on 15/5/07 and received reply 23/5 ....sorry you have cause for complaint.....I have arranged for Customer Service Recovery to carry out immediate investigation....Because of the issues you have raised it may take a little time to gather information but we will respond within 28days
On 24/5 I rec a reply from Customer Serv Recovery, nearly 2 pages, very wordy.
In summary Like any business we make a charge for some of our extra services, extra work, we feel it's fair, we are completely open about this, always there to help etc.
The OFT has published new guidelines on cc default charges. We are still talking it through with them, but the important point is that the guidelines are about 'default' charges. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situations

Sorry etc, We feel they are fair and transparent etc.........In your correspondence you have outlined a legal argument which you say supports your view, we are aware of all the information you have drawn to our attention but we disagree with your legal analysis. However, as a goodwill & withoput admission of liability, I am prepared to credit your ac with the difference between the charges that you have incurred and the £12 fee. Barclaycard reduced its fee to £12 from 1st August 2006. This would amount to £208
Sorry if all this has been a bit 'wordy', I wanted to explained as much as possible.
So, are these replies fairly standard fob offs or are LLoyds right?

I have been successful with Capital One, MBNA and barclaycard. You can claim back the overlimit and late payment fees in the same way as bank charges0
