This is something im unclear about
Can you reclaim all the late fees that you credit card has added to your account???
Also is it possible to that a credit card company can wipe off the late payment fees in order for you to pay them back???

Yes. I am currently at the early court stage with MINT. You can use the same timescales, and the template letters with a little bit of customisation.
The main difference is that, because of the Office of Fair Trading's ruling on these particular charges in 2006 and the reduction to £12, the CCC's always try to use this as a justification. However, even £12 is still "extravagantly" higher than their costs - !!!!!!, the computer just adds the charge to your account, they don't even send a letter! - so they are still unlawful.Also is it possible to that a credit card company can wipe off the late payment fees in order for you to pay them back???

Is it possible that if you ask a credit card company to take off late payment fees on your account that hasnt been paid
E.G Im finding it hard to pay back what I owe because of late payment fees, I have no problem paying back then money I have spent on the credit card but if with the late payment fees that have added up im finding it hard0 -
I see. You can always ask, but I wouldn't hold your breath waiting for a positive reply. As far as they are concerned, these charges are "fair, reasonable and transparent", in line with the OFT ruling and they advised you of them in the T&C's.

I have a number of late charges on my credit cards - before the days I set up direct debits for the minimum amounts, they total about £300 but they are spread over about five different companies.
A lot of people on the boards seem to be claiming thousands rather than hundreds and I wondered if it is worth my while submitting claims for £60 or even £35 as the banks may take a gamble that I will not go through the courts for such small amounts - particularly after the Lloyds ruling. Does anyone else have any experience of claiming for relatively small amounts?
I have sent off an adapted version of Martin's first letter and one of the companies has given me the difference between £20 and £12 but BOS have just flatly refused (sending me a letter full of guff which I will now have to refute). This has made me think that perhaps the fact that mine is a relatively small claim will go against me.
Any advice/comments appreciated.

Has anyone claimed against Yorkshire Bank and won???
I have had all my statements, asked them fot nearly £3000 in bank charges to be repaid and they sent me a letter saying basically it was my own fault, because I agreed to the terms and conditions so should have kept within their criteria. Sent another letter threatening Court action and they ignored it and have not heard anything from them. I am now about to do the curt letter but am now scared, and hubbie now has cold feet too. I have looked at different sites for advice on Yorkshire bank but haven't come across any. Help, I need some willpower and postive answers:eek:0 -
Hi all,
Got a bit of a dilemna. I sent a cheque for £72 to pay a credit card bill last week. By mistake I used my Yorkshire Bank account which had about £3 in it. I received a letter today saying the cheque wasn't paid due to insufficient funds being in my account. The letter also states that I have incurred a £35 administration charge. By looking at my account on the internet I have also been charged £8 PER DAY! for being overdrawn. My account shows I have MINUS £56 in it. I phoned up Yorkshire Bank to ask forgiveness but was told that I could have no money back. I asked for the account to be closed so that I would incur no more daily penalties and was told that if I did this a collection agency would take over my case and charge me extra for the privilege. I am going in the bank in the morning to ask for my money back. I have two options as I see it. 1. I pay the £56 to stop further charges and then try to claim by writng to them or; 2. I don't pay them a penny and let them try to re-claim it from me. Bit worried about the 2nd option though as £8 is being added everyday I'm overdrawn. ANY ADVICE PLEASE?0 -
IMHO, option 1 is your only realistic course of action. It also demonstrates that you have acted promptly to mitigate the situation. This will count in your favour, if not to the bank, then to the court.The acquisition of wealth is no longer the driving force in my life.0

If at all, a small claim might be in your favour as they might settle it quicker, if not, it certainly won't go against you - you will just be in the same boat as everyone else. If it helps, we claimed £110 from Capital One - they paid up after a court claim - fairly usual. And you get the court fees back - I wouldn't pay too much attention to that court case, it is an isolated case.Reclaimed thanks to this site:
