    Write them the second letter giving them another 14 days to come up trumps, otherwise you will file a court claim.

  • I've got my list of charges through from Ikano Financial for my Oasis Store card and they total £192.

    Do you apply the same theory as the banks and calculate the interest as well? :confused:

  • Yes, if you mean when you start a court claim.

    8% on each charge from the date made until the court claim starts, and then daily interest on the total amount of charges.

  • Just about to sue my bank for credit card charges any help would be welcome?

    The Credit Cards are:-

    HALIFAX ONE (HBOS)
    RBS (HBOS)
    MINT (HBOS)
    BARCLAYS.

    The Story:-

    Ive got to the stage where I am about to sue my bank
    In the letters received from the four credit card companies they basically state the following
    "They do not accept the charges are illegal.
    they have offered 15% of the whole that I claim they owe me :-(.
    They also said I would have to take them to court to claim interest?
    is that correct?"

    I will be going after CAPITAL ONE thru a firm that charges 25%
    if I win as this has already taken 2 months to get this far.

    Questions:-

    Just need some advice?
    one question in particular is how to make a small claim against HBOS
    who's address is in Scotland?
    As the Money Claim site doesn't recognise the Halifax address i dont want to waste money on a court fee if the address is incorrect.

  • I've been going through MCOL and noticed yesterday that they had defended and it would be transferred to my local court.

    I've received a letter today from their Solicitor's Cobbetts that they will be requesting a stay and referencing the Test Case.

    I'm guessing there is nothing i can do until i get directions from the Local Court?
  • I have wrote letters to my credit cards companies( alliance & leicester,Citi card and barclaycard) claiming back my charges i have received the statements and calculated the amounts, and sent the standard template stating you have 14 days etc to pay me the money back but i havent received a letter back and this was around 6 weeks ago, i have sent everything recorded delivery. could i apply to the county court as it ha been ages and if they arent going to cooperate then i have no other choice.

    because there not replying i am not sure what to do

  • You need to send them a second letter giving them a further 14 days....there is a template on the main Bank Charges Re-Claim page.
  • Hi just an update,

    Have used Moneyclaimonline the court service, just one today to see how that goes.
    small query if its for a small claim then why is it with a County Court in Northampton?
    Is it because thats the local address of the defendant BARCLAYS BANK?
    seems unfair for the claiment me to have to travel to Northampton?
    I will find out?
    You would have thought they would have put it in court near your address?
    Theres plenty small courts in the North.
    And do I have to turn up? what then?

    Have read thru one thread its huge database on here, thanks.
  • Moneyclaim is where all MCOL claims go to start with, should it get as far you having to appear in Court it will then be transferred to one local to you.

    Why are you going to use a company that charges you 25% for Capital One? There are so many stories on here of people being ripped off by said companies.
