Hi, I posted a few questions in the wrong forum and after some helpful advice from a forum member - Sunil, I have been asvised to ask here, can anybody help with the following:-
Can anybody advise me if I can claim charges from credit cards that are now closed due to payment being made in full to them and the accounts are now closed? These cards were in use within the last 6 years.
Also, MBNA recently took over a mastercard I held with the Bank of Scotland, do I need to write to both to claim charges or just MBNA to recover the last 6 years of charges?
Having read the article on bank charges being held until the courts decide when or if payouts are legal, can I still send a claim letter to my bank now? I didn't quite understand my position on this.
Adding to this - I have failed to bring my account back within it's overdraft limit and the bank want my cheque book and cheque guarantee card returned (Natwest), if I put a claim in now is it probable they will want to close my account and order the remaining overdraft money I owe on demand?

I have read through varying points on what can be claimed from c/c companies but I'm still a little confused.
Can somebody please post a list of what I can claim for exactly from the scoundrels!

I also have every statement I've ever received from 6 different card companies going back 6 years, is there any point in sending off for a fully comprehensive list of charges and paying £10 to each or just working the charges out manually? Or would it be easier just getting a list of the charges from them!
(if I could understand what charges to work upon I'd start immediatley)

I would just work out the charges myself rather than pay them £10 each. You can claim for overlimit fees and late payment fees0 -

You've probably answered this in your previous post by not putting it down but I thought I'd check anyway - is it possible to claim for direct debit returned fees? Where the bank failed to authorise my d/d payment, I've noticed Capital One charge £20.00 for this not checked my other cards but as this is another stealth charge can it be claimed?

Yes Blackcat,
I would imagine you will be able to claim for this. Cap 1 now charge £12 for all these fees, as agreed with the FSA, so you may just get back the difference, but I would give it a try.

I'm sorry to bother you again IZZY, thank you for your invaluable help, would you suggest when I claim these charges I ask for the full amount or the difference i.e. the £8?0 -
I know this has been asked many thimes before but is there an MCOL poc for credit and store cards
if so could someone post a link PLEASE!!
if not can anyone tell me if we need to change anything in the bank POC to accomodate these cards
Lastly is it still OK to use MCOL for Credit and Store cards or should we use the N1? form

Hi all
Just checking my next move with those of you with much more experience of this than me
With both my Capitol one and Barclaycard accounts I sent off SAR's, Received statements, calculated what they owed me and the sent them letters stating how much I was claiming.
In these letters I included the following paragraph
"I hereby give you 14 days to refund the charges back on to me. For the avoidance of doubt, if this is not done within 14 days, I will commence my claim in the courts without further warning. This action will inevitably involve you in additional costs"
I then had letters from both offering rediculously small amounts.
I phoned both in attempt to settle this without the need to go to court, informing them that I would not be accepting their offers ( both have refunded these small ammounts to the cards and I have no way of getting the money anyway as I have destroyed the cards and the Barclays one has been closed due to a high debt that I was paying off at a nominal rate for over 2 years).They wouldn't play ball with the person from Barlaycard giving me an excuse that as I owed them money that they had taken off what I owed and that the offer was for what was left, ( Due to a relative dying and leaving me some money I had paid off all my debts before staring all of this) this statement was wholely a lie!!( Overseas call centre by the way)
Do I now write to inform them that I am going to take them to court or Just do it?
Do you reccomend MCOL or should I use N1? ?????

Ask for the full amount, I think they have been paying this amount out on some claims,
