I am in the process of claiming back charges from Capital One and Mint and have so far received the standard replies offering a token payment. Some of the charges were for £20 but most for £12. Having read Martin's advice on this he says he would be inclined to accept an offer which is based on the difference between the old charge of £20 and the current £12.
I am happy to take my claim further by threatening court action but just wondered if it is advisable to do this or to just accept the companies' offers considering most of my charges were £12?

i'm not too sure about your mint card but with capital one they are really easy to get a full refund off but you would need to issue mcol. i'm in mcol process now after reading capital one thread. their general pattern is they send letter offering difference, you decline, issue mcol, they say they will defend and within a couple of days they say they are paying up in full with interest and court costs.0

Hi, I'm sure there are loads of people in the same boat as me but i'm just not sure which direction to go in, i am in the process of claiming back just over 1,000 from cap 1, i am not willing to accept their offer ( 380)but can't afford the cost to take it to court, the amount i owe is higher than the amount i am claiming so therefore i wont even get the court costs back, i am also about to do the same with citi card which i have no doubt they will also refuse to pay up without it going legal, i've heard that the fos are not taking on any more cases so stuck there, i was also wondering that because i am on incapacity benefit would i be eligible for court costs.
any advice would be gratefully received

Credit cards are not affected by the test case, and Cap1 are easy to crack. If you are on certain benefits, you are exempt from court costs but have to file the claim through your local court, not through MCOL.Reclaimed thanks to this site:

Just wondering, is it worth going through mcol on chasing CREDIT CARD charges anymore?.....it's just that i am not seeing a great deal of success stories regarding credit card claims.
I'm in the middle of claiming from CAPITAL ONE through an m-col..... (claim was acknowledged 16th aug)....
If all goes well with this claim, i'm thinking of pursuing BARCLAYCARD who made the "goodwill gesture" of paying £350 odd out of a £1,100+ claim. I accepted this as a part payment (letter returned to them etc), but i don't want to throw £80+ in mcol charges away to get "STAYED" at court.

I don't think you are reading the relevant threads if you can't see credit card successes. There is a thread for Capital One and one for Barclaycard, the links can be found in the Reclaim Bank Charges Help Thread. Thanks for your reply beate, and yes i read the individual threads every other day.....i see a lot of success with cap 1, but the barclaycard side of things seems to be less positive. Am i reading it "wrong" then regards barclaycard? i got the feeling they are trying the "test case" route?...trying to get cases stayed etc. Hope i am wrong, because they were less than helpful when i fell out of work a couple of years back....(i had a job-the SAME job from 2 weeks from leaving school to aged 29!) and are really up for them!0

I have started claiming back the charges from my Natwest credit card.
I sent the first letter saying.....I am writing to request that you repay all the default charges that have been applied to my account. I do not believe these charges reflect the true cost to Natwest
The charges total £80.00 plus as I believe I have been unlawfully deprived of the money I have calculated £4.84 interest at the statutory rate, the amount the court will award.
I therefore ask that you repay me the full amount of £84.84. I have attached a full schedule of the charges and interest with this document.
I look forward for a full response to this letter within 14 days.
I didn’t include all the one that had been paid back as I figured Natwest would notice (seem to notice when I have gone over but not when it’s because of their charges or interest).
I sent the above letter on 31st July (got proof of postage so I would know when I sent it).
The charges have mainly been debited because I gone over my limit the month before, but this is because of their charges taking me over drawn, each month they go out I don’t get anything letting me know that they will be debited, so they expect me to be psychic, when they do get debited I have phoned up and explained that I went over because of their charges, a couple of occasion they have refund but not on all occasions.
This morning I have received a letter back from them which to be honest is an insult.

I know I’m not going to settle at the pathetic amount they have suggested but I am not totally sure what the next step would be.
Any help would be appreciated.
