Can I claim from credit card

    First off I would like to say a big thankyou to everyone who has posted with helpful tips, addresses etc.. and of course to the man himself Mr Lewis for starting off this consumer revolt :money:

    I am in the process of reclaiming late fees with a couple of credit card companies and have received back my first response, they claim that the OFT think £12 is a fair price for a late charge so the credit card company have offered to pay the difference between the charges that range from £20-30 and £12 this amounts to approx £94 as appose to roughly £250. My question is if I take it to the next step and procede to court am I likley to win the full amount or just end up out of pocket? I get the feeling that this is the course of action that the other credit card compaines will take as the APPEAR to have the OFT backing them. Obviously I would like the full amount back but if there is a chance it would go wrong then £94 is better than nowt :rolleyes:

    Firstly the OFT have not said that £12 is a fair charge they have just stated that they will not intervene if the charge is up to £12, this is their threshold for intervention, in other words if the credit card companies charge £12 or less then the OFT will not investigate the charge.. So they charge £12 the max they can without fear of OFT intervention, this does not make it a fair charge and proportionate to their costs, it does not cost them £12 to print it on you statement, that is the point of claiming we are claiming back unfair charges if the companies wish to disclose their actual costs then we are willing to pay these, but if they do not then we claim the whole amount, in saying that it is entirely up to you if you are happy with the difference between the charge and £12 as a refund, personally I would not be as I still think it is a ridiculously high charge. but as I said it is your decision to make..

    Here is a section from the OFT statement...



    Where credit card default charges are set at more than £12, the OFT will presume that they are unfair, and is likely to challenge the charge unless there are limited, exceptional business factors in play. A default charge is not fair simply because it is below £12. Setting a threshold for intervention is a pragmatic pro-consumer action that is designed to give the industry the opportunity to change its practice without litigation. It is supported by detailed guidance to the industry as to how to reduce the likelihood of public enforcement

    There are lots of people who have received all their money back including interest and court costs once they filed a court claim, myself included. Capital One for example crumbles pretty quickly so don't be fobbed off, and credit card charges also have nothing to do with the OFT test case, so file your claim.

    Can you claim back all the £12 over limit charges and non payment charges from credit cards. I know my CC used to charge me £30 and dropped it down to £12. Is this still illegal and can I claim it back?

    Heres a list of things u can and cant claim, dont matter if its £30 or £12
    they should not charge u at all

    CAN BE CLAIMED

    Account misuse fee
    Cheque return fee
    Card misuse fee
    Unarranged borrowing fee
    Unauthorised overdraft fee
    Unpaid DD fee
    Unpaid cheque fee
    Unpaid standing order fee
    Late payment fee (credit cards, store cards, catalogues etc)
    Exceeding Authorised Overdraft Limit
    Exceeding Unauthorised Overdraft Limit
    Direct Debit/Standing Order/Cheque returned fee
    Irregular fee
    Paid refferal fee
    Total charges (HSBC personal accounts only, not business accounts)

    CANNOT BE CLAIMED

    Cash Machine Withdrawl Fees
    Account Service Charges
    Service Fee / Annual Fee
    Charges related to foreign currency transactions and conversions.
    Monthly account fees on certain type of accounts.
    Normal overdraft interest charges

    i am in the process of claiming my bank charges back and i have now realised that i can claim credit card charges back to. how do i do this is it the same letters as the bank charges or are they different
