I have won my claim against Halifax, and still in the process of claiming against the credit cards I have had. Their date for supplying data was on Monday. Gave them a few extra days, due to the postal strikes we had. However, today I have received letters from most ...., not what I wanted to receive.
Sainsburys Bank, returned my letter of request, no covering letter, with hand written note £10 postal order, no refund.:mad:
2 questions.
1 Are there any template letters to compain to the FO ?
2 Do I write back to the banks concerned asking again for the infomation.

I take it you've sent your £10 to Sainsbury's asking for all the charges that have been lodged on your account from the last 6 years and they've not carried out this wish??
If this is the case you need to ring them and ask them why and get the name of the person you speak to....you need then to complain to the Information Commissioners Office at www.ico.co.uk
My partner is having the same problem with LloydsTSB Credit Cards, they received her letter on the 6th of June and so far she's had all the excuses like...
It's been held up due to the floods and the postal strike...The 40 Days starts when they decide to start dealing with it lol....they are backlogged...they are busy...the department we need to speak to is only open between 9am and 5pm so you'll have to call back.
It's now 66, days since they received the request, we've complained to the ICO and are today due a call from a Manager today.
I have a funny feeling Banks have something up their sleeves regarding the reclaim of Credit Card Charges so they are trying to stall things.
Maybe there's another dodgy handshake deal coming between them, the OFT and the FSO.0 -

The test case only applies to bank charges so none of these are affected if they try and say they are onject at court and ask them to show where in the pleadings in the OFT case does it say anything about credit charges which were in any event covered by the OFT decision last year.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -

Hi,
I have started claiming back the charges from my Natwest credit card.
I sent the first letter saying.....I am writing to request that you repay all the default charges that have been applied to my account. I do not believe these charges reflect the true cost to Natwest
The charges total £80.00 plus as I believe I have been unlawfully deprived of the money I have calculated £4.84interest at the statutory rate, the amount the court will award.
I therefore ask that you repay me the full amount of £84.84. I have attached a full schedule of the charges and interest with this document.
I look forward for a full response to this letter within 14 days.
I also included a list (from the main MSE site) of all the charges + interest.
I didn’t include all the one that had been paid back as I figured Natwest would notice (seem to notice when I have gone over but not when it’s because of their charges or interest).
I sent the above letter on 31st July (got proof of postage so I would know when I sent it).
The charges have mainly been debited because I gone over my limit the month before, but this is because of their charges taking me over drawn, each month they go out I don’t get anything letting me know that they will be debited, so they expect me to be psychic, when they do get debited I have phoned up and explained that I went over because of their charges, a couple of occasion they have refund but not on all occasions.
This morning I have received a letter back from them which to be honest is an insult.

I know I’m not going to settle at the pathetic amount they have suggested but I am not totally sure what the next step would be.
Any help would be appreciated.

If I have all my CC statements going back 6 years, do I have to write to ask for all past charges or can I just tally them up on the charges calculator?
Also if I am in arrears on paying the credit card, can I still get the charges back. Is this the same for store cards?

you dont need to write and ask for a list of your charges. just use your statements (its the same info) and input that on martins calculator.
you can also claim on your credit card whether or not your are in arrears, in debt recovery or even if the account is closed.
you can do the same for store cards but dont be surprised if they decline a refund if their charges are below £12. hope this helps.0 -
Erm, why do you want to ask for something you have got already? Just tally the charges up and be glad you don't have to wait another 40+ days to get them.
If you are in debt with a bank or CC company and they agree to refund you, they will off-set the money first against any debt you have with them, and send you the rest. But at least that debt is gone then!Reclaimed thanks to this site:
