    Short answer - yes

    I've claimed on two credit cards that I no longer have accounts with and have no balance.

    When I wrote and requested a list of charges I didn't even have my account number, I just found the address off the internet (Capital One and Mint) and wrote to them saying the account was in my name and my address - they both responded with a list of charges within 10 days

    I claimed the difference between the £12 OFT guideline and the charge (ranging between £20 - £25).

    I've settled and had cheques for about £400 in total.

    Its up to you if you want to press for the full amounts, but the law applies whether the account is open or not.

  • It depends on the credit card company.

    I wrote to all mine initially and didn't send the £10.

    Capital One, Halifax and Mint just sent a list of charges with no charge
    Egg asked for £5
    Natwest asked for £10

    Give it a go, write and ask for them and don't offer anything, they will either send a list of charges or ask for a payment, you can decide at that point whether to proceed.

    oooooooo thanks for the reply! i think i will!!!! i know cap 1 charged me a fortune!!!!! also, b/c of all these charges i have a ccj from black horse b/c i couldnt keep up with repayments on a furniture loan. do you think i could reclaim those charges?

    In the past I have simply called the bank and grovelled until I got charges back, but I know there are a few occasions when I've been lazy and not bothered. If I try to make a claim won't my bank just turn round to me and say "We have refunded charges in the past and cannot do this again!"?

    I would also like to know if I can claim Credit Card charges for late payments back? If so, do I need a backup credit card like the bank reclaim tactics suggest?

    Any advice offered would be most appreciated!

    Yes i claimed back 120 in late payment charges from capital one.
  • The answer is yes, You can claim all the charges back from the credit card provider, although they will want to refund you the difference between what they did charges and what the OFT said they would do nothing about which is £12. The OFT are the ones who are allegedly the regulator working to make sure that things are fairer for the consumer. However you will be pleased to know they do not make the law of contract so the £12 means nothing in law.

    Yes

    I have only recently started claiming back charges and my first success so far has been a credit card.
    It took less than 3 weeks start to finish
    I asked for £1543 + interest this was for overlimit and late payment fees.
    They wrote back saying all the charges were legal blah, blah...
    I replied giving them 14 days or court.
    They offered £720
    I turned it down
    They then offered £1438
    Obviously I accepted:beer:

    Just follow the steps in Martins arcticle and don`t let them bully you
