Out of interest would you consider taking a guy to the small claims court who stood outside the venue shouting, "tickets for Pink, buying and selling" and sold you tickets for £210 which you then couldn't use when you got into the venue?

Hmmm good point. I think if it was me I would pursue the case just to make a point and annoy the other party, but then I like a argument especially on a moral standing.

I'm not sure there is a moral standing. Buyer knowingly took a risk, it didn't pay off. In fact, the seller is going above and beyond by offering to pass on what they received back from the ticket seller. The difference between that and the price paid is, unfortunately, collateral damage.

Incidentally, how did your friend pay? I know via PayPal, but was it sent as a gift or payment for goods? You could try a PayPal claim if the latter, but this far after the fact it's likely to be unsuccessful.

Clearly avoid doing business with you!

if you purchased a item on-line and all that arrived was a empty box and you were offered half of what you paid as a refund, you be happy at that ? Its the same point really.

I think the point is a private transaction there is that risk.

That's why businesses exist, they offer a service as well as the product they sell.

    Private transactions, greater risk.

Not as a gift payment, but payment over 45 days so no paypal claim

Obviously you wouldn't be happy but there is nothing really you can do as your friend bought the ticket through an unprotected method. This is why people say you should only buy tickets from licensed sellers. It's annoying for your friend but you're basically stuffed.

Its one of these things you just chalk up to experience!

  • OP just to be clear, is the seller someone who advertises lots of tickets on eBay or is just a seller on eBay who happened to have some spare tickets?

    Actually no, it's not.
In that case the seller set out to defraud and never had any intention of providing the item and is a scammer.
In the case with the tickets, when the tickets were provided they were perfectly valid, there was no prior knowledge of a cancellation, and the tickets were sold in good faith. Had the "artist" not cancelled, you would have had valid tickets.
