  • Well after my sorry we're declining you complains letter i phoned the number on the top of the letter my husband did the same with his we asked for our case to be re-evaluated, we were told no problem but this could take up to 8 weeks i did'nt argue the point that it had allready taken since the end of april.
    RESULT:j This morning 2 letters arrived one for me and one for my husband both making goodwill gestures i got an offer of £1825.50 (original claim£3651) and my husband's offer was £1554 (original claim £2702) I went first and called the number ready to regect this offer I spoke to a lovely guy who asked what the problem was I asked him how the had came to this offer, He then told me that this was just an opening offer and he was sure he could improve it he asked me how much i was willing to accept any way we ended up agreeing on £3150 This i was very pleased with until my husband phoned He ended up getting £2500 only £200 short of his original claim. So my advice would be relax and let the bank do all the work and when they make you an offer haggle hard and you could end up getting all your money back.

    This is useful, I'm reclaiming bank charges from two banks for my daughter, and she's just had a letter from Halifax who have obviously dealt with the initial letter as one of complaint. I've written back reminding them that the letter was not a complaint but a request for information under the DPA (although I did include a claim for those charges which I was able to identify from the statements my daughter has kept).

    hi im in the process of changing my mortgage to the BOS, however i am also thinking about claiming back bank charges from them! would this claim make them re-think there offer of good interest rate? or even the mortgage?

    should i wait until its all completed?

    Is it worthwhile trying to phone them even if you have started the court process as I have to wait until August to see if they are even going to defend?

    Any advise please?

    This sounds very much like the letter my daughter has received. As my original letter to them asked for them to repay the charges which I was able to identify from the statements my daughter had kept as well as a request for the charges which appeared on the other statements I don't think I'm going to respond to this letter with the customary request to re-evaluate, rather I have written to remind them that I have asked for information to which I am entitled under the DPA and reminding them of the 40 day deadline. When I have details of all the charges I will write requesting the whole amount and asking for a re-evaluation of the "decline" letter they have already sent. To anyone else out there who has travelled this particular rocky road already, does this sound like a reasonable tactic?

    Hi, having spent my Saturday morning reading this thread from the start I can see that others are saying that keeping in contact with the Bank and encouraging them to settle before the matter gets to court is to be advised on the basis that the courts expect people to at least attempt to reach an agreement before the matter is listed - this complies with my experience in a former life. If I were in your shoes I would be trying to broker an agreement right the way down the line - we know that the courts are overworked so if litigants can help out by trying to sort matters out ahead of a listing then I can't imagine the court is going to object. However make sure you keep a record of all telephone discussions; phone number you rang/date/time/who you spoke to/what was said etc.

  • hi all, for anyone with halifax this is how my case went.start of may sent letter asking statements 40 day's past so rang them was told they could send me a print out of charges,,,yep that will do,got them 2 days later,worked out charges £2600,,,£3020 with intrest.
    sent off letter asking for money back told them they had 14 days to reply,14th day got letter more or less saying sorry u ain't getting nowt (ok no problem i thought)sent off next letter giveing 14 days or will start court action,14th day got letter offering me £1355 as a goodwill gesture.
    rang halifax first thing on the monday morning and declined the offer after much bartering got to £2400,after much thought i took the £2400.
    all i can say is if u get an offer and it will be a crap one when u ring them don't be nasty to them be very calm and nice and u should get a decent offer from them,
    good luck and don't give in.....

    You should still automatically receive the statements (I did). In triplicate:confused:

    I still worked out my charges and sent them anyway, so they knew I had a guideline figure.

    Claiming from Halifax £1130 inc interest
    Original Offer - £593.50
    Offered £1000 - accepted

    I started my claim back in May and have followed the tips given on this forum with success. I received the initial "your complaint has been declined" letter and sent the 2nd letter threatening court back to the bank. A week later I called the 0845 1241300 number to ask for an update and they said it would be re-evaluated and should hear within 8 weeks. After reading peoples success I gave them a call on 01977 627422 and was VVV polite and asked if it could be looked at any quicker. The nice gentleman on the phone said no problem and I should have an OFFER within 3 days. Arrived home yesterday (2 day wait) and lo and behold an offer of £593.50. This morning I called the same 01977 number and got the same gentleman as last week. I thanked him for his quick response but said I wasn't happy with the amount offered. We eventually settled at £1000 which is full amount less interest, success I think!!!! Money should be credited to my account within 14 days - yipee!!
