    Hi folks,
    While photocopying my paperwork to send to FOS, I noticed in the letter, declining my request for refund that the BOS offered to help me run my account a bit better and that further charges would be applied if I continue to run my account in this way. THE BLOODY ACCOUNTS BEEN CLOSED SINCE JUNE 2006 this proves that they don't look into individual cases that much. They have supposed to have been investigating my case for 8 weeks and yet they haven't noticed that it is a closed account!! aye right.
  • i sent my first letter at beginning of April, i already had the list of charges as its in the last 2 years, totalling about 400. I got the wait 8 weeks, letter, then the no letter, i sent the threaten to take to court letter 16 days ago and they havent replied, i go on holiday next friday, will i take them to court or wait until i get back?

    I also sent letter asking for statements on dated 15-4-07 then waited patiently for reply.Nearly 40 days later I decided to ring & ask for update as I'd not recieved anything.The girl said they didnt have a record of my request Ha! Quel suprise! Anyway she said she could generate my request over the phone & debit my account with the charge-got 32 envelopes through the post 2 days later containing my statements.So if anyone is still waiting to request theirs-get ringing!Or at least have a record of posting your request.Good Luck!
  • Hi guys and gals,

    I sent off our letters (Mine and my Wifes) Dec 06, chased in Mar 07 and then resent in April as they "had not received anything". Constantly chased on the phone to the customer relations number and have received two lots of Charge Lists in the last 3 weeks for all 3 accounts. Sent off the 2nd letter requesting refund of all charges plus interest on the 9th June and have just today received 3 copies of the standard decline letter. So am sending the Court Action letter tomorrow and am also going to ring for re-evaluation. Will let you know how things pan out.

    BTW my Sister-in-Law works for Clerical Medical who are part of the HBOS group and she said that they have taken on over 800 staff to deal with this situation and they are constantly recruiting. Sounds like they are taking this fairly seriously then! lol


    Claiming a total of £3081 from Halifax
    So far no offer :mad:

    just to let u know halifax paid before court threat letter

    1. ask for statements
    2. sent first letter
    3. recieved comfromation about subject
    3. sent 2nd letter
    4. received letter from halifax saying i am not entitled
    5. telephoned them asking to re-asses my claim
    6. recieved 2nd letter saying not entitled but offering £400 as a good will gesture
    7. telephoned them rejecting
    8. 1 week later checked account online and i was £400 up
    7. phoned them asking what was going on they said it was proceedure to put first offer into claiments account regardless and was open to negotiations i asked how so they offererd me another £400 there and then on phone which i accpeted as they said they wasnt paying interest


    my overall claim was for £1010 inc interest

    i settled for £804

    if i stuck it out i reckong could have got more but i am happy with result and a big thx to all on this forum for the advice

    I recieved my knock back letter on 8th June. Started process back in Feb!! Rang on 11th june asking for re-evaluation. Did not ring number on letter, but one given on forum. Nice man gave usual blerb about 8 weeks, but probably will take 2-3 weeks, and if not heard to ring. Got home today 15th June and surprise, surprise an offer of half I have asked for! Should I take the chance and go for full lot? I did say that i didn't really want to go down the court route, but will I have to if they don't offer any more?
  • Can one simply just go straight to MCOL without asking them to make one an offer?

    If you can then I intend to 'bang' BOS straight in for the £5183 of charges over the last 3 yeras and for an unknown amount for the 3 prior to that.

    Or do I lawfully have to afford them the 8 week buffer as they're some 6 weeks in breach of giving me the full 6 years statements after the 40 day limit?

    Apparently, they only offer half the amount as a "goodwill gesture", but I was told that these offers are open for negotiation. Give them a ring (being nice of course!) and just say that you are not happy with the offer and give them a minimum amount that you would settle for - can't hurt to try!

    Got the standard rejection letter and asked the halifax/Bos to re-evaluate my mothers claim and was told that she would hear within a few days as there was a time limit on the complaints procedure - still waiting a week later.

    If she receives a "gesture of goodwill" offer and wants to refuse what can she say to them to up the offer?

    She is not sure what to say to them in order to negotiate a better deal!

    Any advice would be appreciated.

    Thanks Janebo will ring Halifax on Monday, will be polite and try. Will they withdraw the offer of goodwill? Can anyone advise?
