i sent my letter informing the yorkshire bank of my intention to take them to court if they did not settle. they had 7 days to reply, the 7th day being today, i have had no coresspondence from them apart from the first letter that i recieved telling me that they were not prepared to pay me back any money as i had not abided by there terms and conditions. do i just start court proceeding or do i wait a little longer for them to reply, i was hoping it wouldnt get to this stage, i just hope im not gonna waste another 120 quid as well as all the charges they oew me. ANY ADVICE ANYONE !!!! thanks0

You've already stated you will give them 7 days, the time is up. They have told you they will not pay, so you need to start your claim. Any court fees you pay will be added to your claim and refunded if you win.0 -

Firstly, I will praise the bank on the speed they are replying to my letters. I sent my first letter asking for the charges to be returned on 29/12/06. Got the first refusal letter on 05/01/07. Sent the 'you've got 7 days to pay or legal action' letter on 05/01/07 and have recieved a letter from them today. The letter states that the complaint has been reopened and they will get back to me asap (definately within the next 4 weeks).
I only see this as a stall tactic and will wait until 12/01/07. If by then I haven't had satisfactory response from them I will be login on to money claim.
Will keep you posted. Hope your all getting on ok.

yes recieved my letter on wed 10th this time from head office instead of my branch, exactly same as your saying complaint has been re opened and they will be in touch, 4 week will take them up to the 7th Feb. gonna do same as you!! keep me posted good luck.

Claim £1563
2nd letter send 07.01.07
Today, 17.01.07 cheque received for £781.50
Am still undecided what to do. Money is pretty tight this month so £781.50 would really help.
Have drafted a letter returning the cheque and counter offering £1350.
Haven't posted it yet............................0 -

hi just wondered if you had recieved this letter and cheque from your own branch or had it been passed to head office, i sent my second letter and recieved a letter from the banks head office saying that they would look in to my complaint and get back to me within 4 weeks. its a hard decision i am reclaiming just over 2000 and even a 1000 of it would be nice money tight for us too. i will probably stick em out for the full amount.0 -
