This looks like confusion on the part of the bank.
If you set a deadline (14 days?) with your letter asking for the charges back, just move onto the next step of the process as soon as this time is up.How many surrealists does it take to change a lightbulb?

Hi all,
I've just received my first refusal leter from Yorkshire Bank for my claim of £4185. They have just reffered to the terms and conditions and given me info on their complaints procedure. I am now writing a letter to inform them that I am taking legal action. I intend to go the whole way with this but I was just looking through the stories from everyone and can't see any success stories from Yorkshire Bank. Has anyone made or currently making a claim against them??
How did you/ are you getting on?
Would really appreciate any feedback. Best of luck everyone.
Also, I am using the remplate letter on this site informing them of the action I am taking. Where it says [insert court name], what do I write, if I intend on using the money claim site?0 -

Have a look here. You may need to register but there is a section dedicated to the Yorkshire bank.

I believe you should put in name of your local court here.

I too am claiming against yorkshire bank for the amount of £2635.17. They sent me a letter reffering to the terms and conditions and given me info on their complaints procedure. I have now moved on to the next stage, i sent them a letter informing them i now intend to take legal action, they have while the 9th jan to reply.0 -

Good Luck, I'm going to get my letter off to them today. I live in London now, but my local branch was in Lancashire.
When I name my court can I just pick out the nearest county court to where I live now? (Stupid question I know but don't want to mess things up before it starts getting serious).0 -

In 2002 I was incensed by Yorkshire Bank charging me £45.00 for going overdrawn by the sum of £16.88 for just three days, my only action at this time after complaining was to close the account.
I now understand such excessive charges are illegal and asked for refund 2/1/07 have received standard letter attemting to justify and quoting terms and conditions.
They suggest any further complaints by me should be towards the financial Ombudsman. Surely this is a valid option any reason why this should not be done and does anybody have experience of claims via this route.
Finslly they state that if I go directly to court they will counterclaim for my Breach of Contract. What is that all about0 -
Seems to be their standard reply and means you have to follow up saying you will take them to court.0

Hi all,
I have been a member of the email list a while now, but only realised in December about claiming back bank charges.
Not SUCH a long story, but I am a 40 year old mature student in my final year of a BSc---I have been with Yorkshire bank for 15 years and the last couple of years due to my eldest child and grandchild leaving home-have been 400 a month down, and living on a student loan and child credit for one child-YES, i shouldve got a job but havent .
I have an overdraft of £600.
A drop in the ocean to many I know, but every Summer and Xmas, I struggle.
I also have a saving account with Yorkshire which last year I transferred money to live on-and kept D/D payments in main ac.
I went 2 pounds overdrawn on the savings ac, and basically ignored that--6 months on--267 in charges.
At Xmas I was upto my 600 overdrane and no money going in till the 8th Jan, so I went to bank-realising I had probs, and cancelled ALL DD's.
That day they had bounced a DD, but because I went up-they refunded the 35 charge to account-I put in 75 and I was 'within' my 600 OD again.
couple of days later a switch I had forgot id paid went out-so 3x £8.00 a day charges and I realised-went up and put more moeny in .
I got money for xmas--put it in.but obviously used it to shop too.
last Friday-I AM REALLY tryng here! I WENT 602 od, raided piggy bank and took £4.00 in 1p's up...
Sooo---today I have 1200 in--student loan and child grant in-600 OD= 1200. plus I HAVE paid a few bills so expect another 300 to come off.

On way home-my 17 year old calls me-quite annoyed-the bank have called and asked for me to call them-VERY Sharp message-very abrupt and rather impersonal--their perogative.
BUT---A second call followed where they forgot to put phone down--I have 30 minutes of their conversation. 10 about me!:mad:
Basically, the one calling states--"SHE isnt answering the phone now!" then asks anyone in office " does anyone know anything about 'this' Janet Y**** ? ...any stories?"
The girl I saw proceeds to tell them I went in before Xmas, and fills her in on the situation,down to the fact that I have been in, stopped DD's, told her No, I havent made any more switches and then gone and switched something(like, on pyrpose) informed them(whoever there) that I am IN TROUBLE financially, and needed help :rolleyes:
the the girl who called starts being rather aloof about the charges on savings account and states that collections have been in touch suggesting the bank refund all the charges if I will pay the 2 pounds I went OD--To which you hear someone say " well, i suggetsted that!"
I am presuming they have received the letters now asking for refund of charges:T
soooo--WHAT ON EARTH do I do Guys?
My daughter suggests withdrawing all money out and putting it in her ac.
I pointed out they have a right to an opinion, but she is doing law and also worked in a bank(work experience) and says they are out of order discussing me like they did-I am not so sure, but as she says, its THE WAY it was said!
As a student, I am unsure if I will get an account anywhere else-its not like Im just starting out although I havent tried very hard.
I rely n my OD, But would it be untreasonable to draw all available funds out--im feeling it is BUT i USE the OD BECAUSE of previous charges.
Basically, when I call them tomorrow-and IF she mentions the Charge claims, how do I handle it?
and do I mention that I heard them being VERY rude about my situation or do you think THAT TOO was deliberate...make me feel uncomfortable etc.
Sorry its so long winded, and I wont do ANYTHING till I am suitably advised.

Sorry its all a bit confusing reading your post but I would write and complain about the phone call and continue with your bank charges reclaim via letters, don't discuss this on the phone with them as all your letters will be needed if this comes to a court claim.0
