Please urgent help with 'illegal' car sold by garage

    What are the 'fees'? I would ask for the refund in cash otherwise that gives them more wiggle room plus the option to bounce the cheque, etc.

    Or you could hold back the V5, keys, etc. until you actually have the money in the account.

    Thanks KTF. they haven't said what the fees are. she's just text them back saying she wants the cash as she needs another car for work.

    She needs to phone them again and tell them she wants to appeal against the result of an MOT test...not witter on about the garage/car and their faults

    It looks like shes getting a refund minus fees of £250.
    As they need car back, i'm thinking for her to take it straight to the garage when it gets picked up and leave it outside?

    Phone Vosa again, as Joe Horner suggests.

    Here are the details about appealing an MoT, from gov.uk
    If you think your car has passed incorrectly

    Contact your local VOSA office as soon as possible - you can find the address from your MOT test station or by calling 0300 123 9000.

    If your complaint is accepted, you’ll get an appointment within 5 working days to recheck your vehicle for free as long as:
    • no more than 3 months has passed since the MOT test if it’s a corrosion-related problem
    • no more than 28 days has passed for other defects

    You’ll get an inspection report listing any vehicle defects and advisory items.

    Why is she accepting this? And what are the fees?

    Unless the garage is offering 100% of everything she has paid out, right now, in cash (not within 7 days) she should say no.

    She's accepting it as they are not and will not stand down about the £250, even when i said about trading standards and phoned them while i was thier they were not at all bothered and said TS would also say £250 is normal.
    I think she really needs to take this and run for the hills.

    £250 isn't normal at all. It's probably what they paid for the pile of junk in the first place ....

    No she doesn't!

    Ignore everything the garage says, unless it is 'Here is a refund of everything you've paid in cash'. They will tell you all sorts of rubbish.
