I've skim read this and it appears daughter bought a heap, complained about the battery, got it changed, found an, "expert" who amongst other things, diagnosed rusty discs. Daughter then negotiated (agreed on a deal) money back to fix faulty items and then, presumably same expert diagnosed HGF.
Get it back to the expert, he'll be a continuous drain on the daughters resources, but in the vernacular, hell mend her.0 -

No, but they could claim that she damaged the car by continuing to use it with the coolant leak (which she knew about by then), making the head gasket her fault.
The head gasket can then become a gasket + warped head + water pump etc when they inspect it, leaving not a whole lot of change out of what she paid for the car. And it would be very hard to fight them on that because she did use it after the coolant leak was known.
On the other hand, the likely dodgy MOT precedes all that and is entirely down to them and the MOT centre they use. Which is why you should stop trying to negotiate a settlement and CALL VOSA!!!!!!
If you don't do that soon (and especially if you let them anywhere near the car in the meantime) then you'll end up losing the option and there'll be MUCH less chance of a successful outcome for her.0 -
Yes your exactly right, they are fobbing her of and she's letting them.
she called garage, they said they'd call in an hour, she called back in an hour, they said they'd text who is suppose to call her, she called back they are saying they will get supervisor to phone her, and so it goes on.

nothing they can do, they told her to call trading standards as the car is unfit for use/sale.
She phones trading standards who told daughter to write a formal letter about all thats wrong and to give garage 14 days to reply.Mortgage Jan 2007, 60000

Garage text her to say she's to bring the car in with all paper work and they'll refund minus the fees within 5-7 working days.....she paid by cash.

What did she say to them?
If she phoned and asked what she could do about getting her money back then they won't do anything becaise that isn't their job.
If she phoned and said simply and clearly that she "wants to appeal against an MOT pass" (which is what was said in my original post) and explains the items that she thinks it should have failed on - exhaust, brakes and wiring - then they will arrange to have the car retested because that IS their job.
eta: the call should go something like this:
"Hello, this is VOSA, can I help?
"Yes please. I bought a car on Saturday which had a new MOT pass on Friday. It's been looked at by another garage on Monday and they've told me that there are several parts that certainly shouldn't have passed the MOT including the exhaust being broken in half and melted wiring to the battery. I'd like to appeal against the test pass please.
"Certainly, madam, if I could just take some details......
She should NOT try to get them involved in all the rest, but they WILL get involved in dodgy MOT passes.0
