Please urgent help with 'illegal' car sold by garage

  • My discs are always rusty if I don't use the car for a bit. Cleans off when you use the brake - not an MOT fail unless there is pitting.

    Did the car have an MOT certificate to start with or was your daughter just told there was?

    I'm also with mad_rich that your daughter might have been told it had just got through the MOT and needed work on it. This is based on the fact in your first post you say your daughter was told about a battery problem and still accepted the car.

    Just a quick update.

    Daughter went to work in car, its now broken down with the head gasket gone.
    Mortgage Jan 2007, 60000 :(. Jan 2011, 46,132.86. Feb 2011 45,699.72. July 2011 44,722.48. July 2012 42,400.34. Sept 2012 41,673.83. Jan 2013 40,652.53
    Dec 2014 34,834.18 :-)

    No the garage dug their heels in pretending they told her about the battery but when theu realised she wasnt goong to back down that they hadnt they decided to come out and do it. Now its broken down they told daughter they have washed there hand of the car.

    The blown head gasket will make an appeal test more difficult but they should be able to work round that.

    The exhaust being "in two parts" less than a week after an MOT is someone signing tickets off for sale. There is NO way a "pass and advise" exhaust would fail like that in that time and no way a tester could "miss" an exhaust in that condition so, even without the other faults, it's a deliberately dodgy MOT.

    Oh, and don't hang around or mess about trying to talk to the dealer - phone them tomorrow for an appeal against the pass!

    They cant, I do hope you follow peoples advice and fight it.

    and (some) car salesmen wonder why no one trusts them, mind you they havent been on this thread yet standing up for something that is wrong.

    Legally you could spend a year of your life chasing this and if you were in tears yesterday then chalk £250 up to experience.

    In future, one thing to do is get a council MOT test.
    They are not looking for work so no conflict.

    It will cost you about £50 anyway so at this point I'd put £250 as water under the bridge... your next step is Small Claims and his will add up costs you may or may not recover in full.

    I'd bet that after a year of heartache you would be really happy to get £1750 back and just draw a line under it!

    Of course you might get £2500 back... but honestly, if you were in tears yesterday just go for the £250 as experience.

    I am guessing that the playing field has moved on now she has been driving it and the head gasket has blown.

    Too late now. They kept using it and not the head gasket has gone. That offer is off the table.

    Going to the small claims court now seems the best bet.
