 A quick browse near me shows you can get plenty of 2002(ish) for the same price like this Zetec:

 You MUST do so within 28 days of the test (and you're 5 days into that already), so stop trying to get results elsewhere and just do it! There is NO charge for them retesting the vehicle when you're appealing against a pass so it costs you nothing.
 They don't care at all what the garage may have done to "put things right", all they care about is dodgy garages issuing dodgy MOTs to sell dodgy cars. This is exactly the sort of thing that gives the whole MOT scheme a bad name and they take it VERY seriously.
 It will cost one local rate call to speak to them, you'll be amazed how helpful they are and, with a successful appeal against test, Trading Standards will be all over the dealer - quite likely inspecting every one of their vehicles to find out how many are dodgy. They may even get enough evidence for a case against him for selling unroadworthy cars (criminal offence) out of it.
 Seeing as it appears a full refund obviously isn't going to happen by negotiation, the best you can do is close the !!!!er down so they don't do it to anyone else. An appealed test will also give solid grounds, regardless of any "help" the dealer's offered, if you do decide to go for small claims because the original sale will have been shown to be illegal (and therefore voidable)0

 Ok and update. daughter phoned trading standards (we have a log number) they said to daughter phone the garage, see what they say, get back in touch with TS is garage won't help and trading standards will go through what can be done.Mortgage Jan 2007, 60000 .  On the latest published figures I can find (2008 because on-one's asked since then), about 83% of "inverted" appeals were upheld, so they DO take this sort of thing seriously:

            Garage, along with a letter refusing the vehicle as detailed in a previous post.
 Keep any receipts for the cost of towing it as well.0

            Call VOSA. Ask them where they'd like the car delivered. Back to the garage may not be a good idea because that gives them a chance to hide the problems.0
