I don't understand why they've used a calculator to value the house, when it's already been sold/stc.
Surely, the value is what it has sold for.

Exactly ! Not really adding a value to the case and demonstrating no attention to detail as I've written to her advising the sale price with estate agent fee and solicitor charge so we know exactly the asset value 'it's worth what someone actually paid' unless I've missed something?

Particularly bonkers since the net value you have posted in less than their calculation but presumably they have not taken into account fees and legal costs?

So they have done a crap job to nil effect.

However, I think you need matters settled so you may have to grit your teeth slightly 'til after the FDR anyway rather than get mad.

And nice for her to offer support of someone who know burger all at cost? Could you pick up the papers yourself or do they have to brief the barrister?

My suggestion JackRS, is put together your own very tight very clear brief summarising the salient points from your angle.

Again you have been let down by your solicitor.

Add all the errors to your exsisting list.

Counting the days now, 9 to go.

    Take care

Hi Jack - I've been quite quiet in recent times, but have continued to follow your story. Your tales of your solicitor have only reinforced my opinion and own experience of those bottom-feeders. I had to report my last one to the Legal Ombudsman - and he was the Head of Chambers! (and I got money back... not enough though!)

My advice to you for your day in court would be to go it alone. I defended myself when my ex took me to court for custody - I had to go back 5 or 6 times as he kept appealing. The judge does give you much more leniency if you do that - "trying to save money m'lud" - and you're obviously not a stupid man, you'll be fine. Just speak when you are spoken to, don't interrupt and all will go well.

It sounds a scary thing, but believe me, if I can do it, you can!

Further, how decent of her to 'ooh, just remember she's on holiday...Sorreeee!'
Jack, you might well thank your lucky stars she ISN'T there, given her performance thus far...just like the last minute pregnancy of the person this one replaced.

The whole thing stinks, Jack - as exemplified by this:
'. Sometimes it is worth offering this amount of money to the other party to settle matters rather than have the uncertainty, stress and costs of a further hearing.'

How DARE she even set those words down to you?!?
What has all of this deliberate delay and faffing about been due to, with this FDR set as the SOLUTION to all that has gone before?

What does she think your state of mind and well-being has been so far?

Apart from almost-ex, who and what else has added immeasurably to those very things for you?

RAS is right, but that doesn't stop me spitting out 'shameful,
lackadaisical, slack, shoddy, unprofessional, unconcerned' in response.
    - and here's me, having just laid the last marzipan round and 11 balls of same on a simnel cake
, as The Last Supper and 11 Disciples , and putting it back in oven.

That woman[and previous], this firm, needs to feel the heat turned up from the Solicitor's Regulatory Authority and The Law Society, let alone almost-ex.

Just hang on in there Jack and take real care of yourself in these countdown days - 9 to go.

Hope you are finding some good fighting surges too, gigervamp. Thought of you in Church when pic. of one of ours with her dog, in hospital for penultimate chemo, was enlarged and brought in for us all to write back on.

Please see attached where I havecorrected items in red.

I am confused why you have spentresource on the house price index, as I have informed you previously by emailthat the sale completes 27 March for £297,000 net proceeds £291,825following estate agent and solicitor fees. I know you have seen theseemails as I was charged 6 minutes for reading them. I trust I will not becharged for this activity, so please make clear that reduction in the billdetail.

I have updated my account detailsas of today see table below. I will make 3 paper copies of statements andpost to you as soon as I can.

    balances

    Total debt @ 24/03/2015
    -£16,460.01

I do find it disappointing that you are not ableto support the hearing and couldn’t inform me until the week before but Iappreciate some things are not avoidable. I feel that there is littlevalue someone else could add to proceedings as surely I have greater knowledgeof my case, I’d assume the barrister would be provided with my file? Therefor I do not wish for one of your colleagues to attend.

Thank you for your email andyour comments on the documents. I have now amended these and sent them toxxxxxxxxx in the hope that we can present one set of agreed documents tothe District Judge. The Brief to barrister will be sent to him intonight’s DX so that he has ample opportunity to prepare for next week’shearing.

I apologise that I completelyforgot you had sold the home. It must be a relief that the sale isfinally going through. The solicitors who are handling the sale for youcan hold the sale proceeds until an agreement is reached. The sale hascome just at the right time!

You will be very safe in xxxxxxxhands next week. xxxxxx is a very experienced barrister who is very calmand measured. He won’t have your file but will have the brief and a copyof all of the documents that have been filed with the Court. I have askedhim to contact my colleague xxxxxxxxxxx should he need anythingfurther.
    Regards

'I apologise that I completely forgot you had sold the home.'

Good grief!... but are we surprised? Are you, Jack?

    - and 'the house', not 'the home'...a long time since it was that for you.

You will create a real one in due course.

Is it definite still that Andrew Day cannot plead for you since date changed?
