Have not you paid for actuary report already ? Why did you need to pay if no report done ?
No not been asked to pay yet which implies they haven't completed it, which is a worry with 2 weeks to the FDR hearing.
I've not heard from my solicitor which is basically what I asked for unless there was something to report. However with just 2 weeks left I feel I will need to write and ask her to confirm that things are on schedule and when I will need to update my financial disclosure for the case (latest statements etc).Regards

I’m sure you are well aware we are two weeksaway from the FDR, so obviously I’m nervous that the Actuaries reportdoes not seem to be complete yet and if the required preparation is in place,so I’d like to make some requests please:
1) If the actuaries report is not complete please can you secure acommitment from them to achieve a suitable date (when you think it’s requiredby to prepare for the hearing) maybe with some payment penalties for not achievingas they seem to have no consequences for any delays.
2) Do I need to make a final submission of statements from the last ones Isubmitted, if so please confirm by when I need to submit them to you so I canplan printing and posting.
3) I assume that there has been no progress in terms of reaching anagreement prior to the FDR so we are proceeding to that hearing on 2ndApril. I assume my attendance is required, at what time do I need to bethere and how long for?
4) In terms of preparing the barrister for the hearing will I have anopportunity to express my wishes and desired outcome?
Please can you ensure we do not have anyfurther delays, missing the 2nd April is not acceptable. Iappreciate that certain things are out of your control but please establish atthis stage what the critical path is and identify the risks, then we have achance to manage those risks. I’m sure this is part of your normalapproach but for me this is the first time I’ve been involved in this processso I need your support and guidance.

Why on earth do your children "obviously" need jobs ? They are in fulltime education.....Do you expect them to give that up simply because you've chosen to move out ?
You need to seperate your marital finances. If your wife is job seeking she should be claiming JSA and tax credits for the children should be claimed by her as a single parent not as a joint claim as is possibly still happening at the moment. In addition as mentioned you should be paying child support of 20% of your income either as a private arrangement or via the CSA

Thanks, yes it's very normal for most people to be working while in education, those who don't have to are very fortunate but perhaps miss out on some of life experience of having to juggle and prioritize.
I was actually fortunate, when I did my degree I was sponsored, paid a bursary wage and paid for all the holidays as I was back in company.Regards

I did too, and most people I knew while I was at uni.
Don't get me wrong, my parents helped me a little bit, but not enough for me to have a life. A job while at uni also helped me meet people, develop my social skills and prepare me for the FT working world.0 -

Pensions Report
I have heard from Actuaries for Lawyers that the report willbe prepared in time for the hearing. The actuary noticed that xxxx's CETVhad been calculated incorrectly and it took over a month for xxxxxxxxxxxLocal Authority to return to them on that point. Actuaries for Lawyershave said that the report will be available on 30th March2015. I have asked that it is sent by email and informed them that thesooner they can prepare the report, the better!
Preliminary Documents
I now attach the first draft of the preliminary documentsfor your approval. The first thing we need to do is try to agree thevalue of FMH. I attach a scan of the Nationwide House Price Indexcalculator which estimates the value to be £298,837 based on the values of otherproperties in that region. Is that figure acceptable to you?
I would grateful if you could please carefully check theattached schedule of assets. This sets out the pot to be divided.
There is also a schedule of issues which highlights to theDistrict Judge what we will be asking him to deal with.
Brief to Counsel
This sets out your instructions to your barrister. I havecarefully gone through your file to extract the key points as you havedescribed them to xxxxx. Please do let me know if there are any furtherspecific points or amendments that you would like to make.

Finally, I would be grateful if you could further updateyour information. There won’t be too much to do as you last updated thecourt and xxxx solicitor in February this year. Please let me have:

2. Statements for your First Direct account ending from 15 January2015 to date
3. Updating statements for your Halifax Easy Cash account from 22 January2015 to date .
4. Credit card statements in respect of your Lloyds Bank Platinum card fromJanuary 2015 to date.
5. Updating statements for your Tesco Clubcard from January 2015 to date.
6. Credit card statements in respect of your NatWest credit card fromJanuary 2015 to date.- A statement for your First Direct loan if you have this.
- Statements for your Santander credit card from 28 January 2015 to date
I have had no response to your offer of settlement sent on24th February 2015. However, the majority of cases do settleat the FDR stage. This is because there is a certain amount of pressureon both parties to reach an agreement and finalise matters. If asettlement is not agreed on that date, your case will be listed for a finalhearing and the costs of going to that final hearing could be a further £4,000- £8,000 plus Vat each. Sometimes it is worth offering this amount ofmoney to the other party to settle matters rather than have the uncertainty,stress and costs of a further hearing.
I have asked your barrister to meet you at Court at 12:30 on 2ndApril. He will speak with you about your case beforethen speaking with xxxx barrister to see whether the issues between you can benarrowed. At 2pm you will all go before the Judge. Both your and her barristers will set out your respective cases. The Judge willthen give an indication of what order he would make if he were the Judge at afinal hearing. He will invite you to carry on negotiating.
If an agreement can be reached, an order will be drawn upand approved by the Judge that day. If not, an order setting your casedown for a final hearing will be made.
I am actually on holiday next week so am unable to attendcourt with you. However, I can ask my colleague xxxxxxxxxx to attendif you would like. Her hourly rate is £130 plus VAT. She would beable to bring all of your files to court should an issue arise. She willalso make a detailed note of the hearing for your records. I look forwardto hearing from you on this point.
