    Been following you from the beginning Jack.

    Haven't felt able to post much (too close to home) but completely understand what it is like to pay shedloads of money to people for their professional services to represent your best interests..(not just marital - in my case it was surveyors and cowboy builders)..and then find they were/are just paying lip service for their fees.charged.

    So whilst paying them to provide help with Battle no 1 against ex-wife - You then have battle no 2....trying to get a resolution/redress from the professionals in terms of lack of actions over Battle no 1.....and sadly this just goes on and on......

    Really hoping that a fair and just settlement between you and exMrsJackRS will be decided upon and that you can finally draw a line under this shortly and rebuild your life.

    Good luck Jack - me and the guinea pigs have got our fingers and paws crossed for you.

    I've lurked in this thread since the beginning and want to wish you well in court next week. I hope you find a fair resolution and can move on with your life in a reasonable fashion.

    Ah well more flesh for your complaint about her total cluelessness and lack of ability and performance I suppose.

    What happens if the judge decides something is missing from your file as she's too busy sunning herself to be there with the file ? Another adjournment ....or do you have a full file yourself too ?

    I hope all goes well next week at your court hearing Jack and hope the Judge agrees to a fair settlement. I find your solicitor's incompetence and inattention to detail incredible and think you definitely have grounds for complaint and hopefully some sort of recompense on the incredibly high legal fees you have incurred during this whole sorry mess.






    Incidentally have your son and daughter actually passed their driving tests yet?

    Had it confirmed that the money for the sale is with the solicitor now so all complete and ex has moved to her parents last night.

    I wondered if we should take a joint account out to earn some interest while wait for settlement to be decided and drawn up. Must be possible to set up a savings account that requires both signatures to withdraw? It could be a few more months yet and a months interest on £292K is £243 if interest is 1% !

    Actuaries report in 38 pages, can't begin to explain what it says but it doesn't tell me what discount to use for cash now value, so I have asked my solicitor to advice asap!

    Jack, not asking provocatively. but is she really best person, relevantly qualified, to accurately advise this?

    Fair idea re: a/c. but you are not dealing with a like-minded person. Please be careful on this one. I'm sure others will have wise advice. RAS?

    Just to mention, your solicitor's policy on interest payments should be in their client care letter. It's all a bit complicated, but in general, interest earned on money kept in the client account may be payable to the client on a fair and reasonable basis. i.e. many solicitors have a de minimis rule where interest of less than £20 per month would not be paid to the client, but sums above this amount may be. Money kept for certain reasons would not have interest payable to the client, but check in case yours does. The money is unlikely to earn as much interest as you could get in a private account, but it's worth asking the question or digging out the client care letter to see if you would get interest from the client account and if so, whether the difference in interest is worth the aggravation.
