Separated, how much should I provide?

    It may not be new but for furniture check out www.freegle.org.uk and freecycle; one of the probably operates in your area.

    Your problem with llets is that the shortest is probably 6 months, so thats a fair committment.

    The ex said I could take the 2 seater sofa from the lounge (leaving the 3 seater) and the double bed from spare room so it's the basics. Kitchen white goods are what I'd need, some places have them included.

    This still sounds as if you're not in the right frame of mind to stand up for yourself!

    The stuff isn't hers that she is giving to you - they are joint possessions and you have as much right to them as her. The sharing out should be equitable!

    Once you find your accomodation, join the local Freecycle or Freegle group - there are always washing machines, fridges, freezers etc advertised thereon - as well as smaller electricals (microwaves etc). When we downsized, we gave away loads of stuff - and I've also received some bits and pieces (a breadmaker, for instance - didn't use it much so I put it back on Freegle!).

    I asked my solicitor about closing joint account but she mentioned some case history of clients that had taken that approach and also of just providing what they thought was enough. What has happened in those cases and a risk in mine is an application is made to the court for maintenance which means I would have to pay what ever they judge plus additional legal fees. So she is recommending a more reasonable and practical approach of giving a time frame to close the account etc.

    My solicitor thinks that because my wife is planning to move south end of July and has no intension of getting a job in the current location that I will need to continue to fund her to a reasonable level. She has been asking her solicitor to provide what she thinks she needs. So far they have been refusing to provide and this week my solicitor sent the following letter. This approach will be considered more reasonable in final court settlement and generate less legal costs. In the final settlement my solicitor believes because my wife has not worked for a number of years that she will be awarded an allowance on top of the amount calculated for the children. Below shows the content of the letter my solicitor sent yesterday.

    Solicitors letter:
    We write to inform you that our client will be closing the joint account in 10 days time. Our client sees no reason why the joint account needs to stay open going forward now that the parties have separated and you will no doubt agree that it is not advisable that a joint account remains open following separation.

    Our client has informed us that there are a number of direct debits that continue to be paid from that account. The majority of these direct debits are in connection with the former matrimonial home. As your client is continuing to reside in the former matrimonial home these direct debits will need to be transferred to your client’s sole account. Our client has already transferred his direct debits to his sole account.

    For clarification, the following direct debits will need to be transferred to your client’s account:-

    1. BT Group PLC, telephone landline = £27.42
    2. CIS F & A Insurance, House and contents insurance = £40.18
    3. British Gas, British Gas service plan = £19.59
    4. Plus Net PLC, Home internet = £19.19
    5. BRGAS, Gas = £72.00
    6. BRGAS-Electricity, Electricity = £55.00
    7. Anglian water, Water = £42.00
    8. SOUTH, Council Tax = £183.00

    TOTAL = £459.10

    In addition, there are direct debits relating to your client’s personal outgoings:-

    1. Specsavers Finance (contact lenses) = £18.00
    2. Specsavers Finance (contact lenses) = £22.00
    3. Specsavers Finance (contact lenses) = £22.00
    4. DENPLAN, Dental Insurance = £22.90

    TOTAL = £84.90

    GRAND TOTAL = £544.00

    Our client will pay an interim payment of £1,000.00 pcm directly to your client’s sole account in order to cover these direct debits. We stress that this is an interim arrangement only pending a resolution of the financial matters.

    So far as the children’s driving lessons are concerned our client is providing payment of £240.00 directly to the driving instructor to cover the children’s lessons for this month.

    In closing, as per recent requests, we look forward to receiving your client’s list of outgoings. If your client is claiming an interim payment her income needs must be provided.

    I gave my wife 2 days notice of a pending visit for me to collect some things. She said the time I proposed wasn’t convenient so I agreed to half hour later. Just before I got there she text to tell me ‘Have moved your stuff out of my bedroom to the spare room. What you don’t take I will put in shed’. So sure enough in the spare room 5 bin liners with all my clothes piled in! Thing is where I’m staying I have no wardrobe so live out of a case. I wrote back telling her she was being unreasonable and as it was my house also my things should be left in the spare room as in the shed they will get damp and ruined. They’ll probably be burned on the front lawn next?

    If you are still paying the mortgage surely you have a right to enter your own home :eek:
