    Mistake or not, if the law states that a security guard is not legally allowed to physically grab someone, then IMO this needs following up if only to teach the people concerned that there are certain requirements and responsibilities that go along with them doing their job.

    Disagree, the OP says the guy was visibly upset, I think he's probably learnt.

    Maybe, maybe not.
    However, will the store manager have learnt anything and will their training and procedures change because of this one incident or will it be forgotten about in a matter of days?

    If I was in the store and I assulted the store detective or store manager, I doubt if there would be much hesitation with me being prosecuted and I don't think it would ignored simply because I looked a bit upset.

    I think that if I was "grabbed" by someone from behind who hadn't made their identity clear, I would possibly instintively lash out. Would I be guilty of assault if this happened?

    Probably not, providing that your response wasn't OTT but I suppose it ultimately comes down to the police and the CPS.

    Whilst I agree to an extent, had "the shoe been on the other foot", I am sure I would have had the full force of criminal charges, Civil Recovery and possible compensation claim.

    Moreover, I consider that I have a duty to protect other consumers, who perhaps do not have the same confidence as I do!

    Had a shoplifter in his little office been "visibly upset", would he have let them off without police/Civil Recovery etc??
