You have to be careful if you owe money to a company like on a CC or loan and bank with them with a current account as sometimes written in there terms it says they can withdraw the money from your account.

This is the reason you get advised to have a new current account more than because they withdraw the banking facility. Its what Lloyds threatened with us but by then we had our new account and I think it is pretty standard to read your terms and conditions very carefully!

Blimey scottishmummy, I thought I was having a bad day.

Received a letter from MBNA threatening court action, etc. but on ringing them they say we are simply on their poverty list or something similar and that after three or four months they will sell on to a DCA. Also said they won't be accepting Payplan offer of payment as we will take too long to clear debt. So not good news in a way unless I can find a lump sum to keep them happy. At least they have frozen interest and charges.

Good to hear from some of you regulars and no I wasn't offended sweety.;)

Dr J Same thing has happened to me with Citi Cards. Because i'm not paying at least 1% my a/c is being dealt with by the "severe hardship dept" and in 3-4 months my a/c will be transferred to a DCA. They also won't freeze interest and charges until they have received 2 months payments.

Sorry, but I need to rant.

Just when you think things are finally settling down, it all goes wrong

I lost my job a year ago, I was the main earner in the family. As you can see from my sig, I have huge debts, but I have chosen to repay them, rather than go down the bankruptcy route.

Earlier this year, one of my creditors refused to accept the amout being paid via CCCS and started court action.

The court agreed with my budget, and the CCJ was issued, with an order to continue my payments at the same amount.

My creditor then went on to request a charging order, due to a missed payment - I have never missed a payment and CCCS have confirmed this.

Anyhoo, the charging order was recently granted as I didnt have the bottle to attend court and fight my corner - I have read on here it usually makes no difference anyway.

Tooday I have received a further letter, threatening that if I dont send them a completed income and expenditure form, they will either

a - send a debt collector to the house
b - apply to the court for an Information Order
c - apply for an attachment of earnings

All of the above has added a further £1400 to my debt in costs etc.

My creditor has taken all this action against me, added £1400 to my debt and for what? The courts have already agreed I can pay no more than I'm currently paying
Is it better to aim for the stars and hit a tree or aim for a tree and land in its branches

Well I woke up today thinking of going back to bed as soon as DS was out the door to school however when I saw the blue skies outside the kitchen window I decided to stop being so miserable and to just get on with things. I have a load in the washing machine and am showered. Not yet dressed but wanted to pop on here in the morning for a change (and didn't want to wake DH just yet either). I have a couple of phonecalls to make one to Experian to say I do not want to continue once my free trial is up and the other to CCCS. Still dreading that one but it has to be done - will let you all know how it goes later. Postie hasn't been yet but not expecting anything.

Hope the day has started bright for you all.

Oh s*** HSBC have paid Mint twice this month! Do you think this will affect the DMP? Is it worth phoning them and saying that it was part of a lump overpayment and not a regular payment? Panicking now!
