Hi all,
Don't know if you remember me - I posted a little while ago when I was first setting up my DMP with Payplan.
Things have been running smoothly until today when I received a letter from Abbey (MBNA) with an extract from the land registry - they are threatening to place a charging order on our property unless we agree to their repayment amount - more than what we can pay on our DMP.
I phoned the name on the letter and the girl was very nice at first. She explained the situation to me but then started to push me into giving her my savings that I need for my business expenses. I told her I wouldn't as giving her my savings would leave me short later in the year (not having savings was how I got so badly into debt in the first place).
She told me that I should make extra payments direct to Abbey. I told her this wasn't possible and it wouldn't be fair to the other creditors who have agreed to the DMP. She told me that it wasn't fair that I borrowed money and am now not repaying it. She also told me that she speaks to lots of people who are with Payplan that make top-up payments direct to Abbey. I told her that that wasn't fair as people are on tight budgets and they'd be taking some of their grocery money.
We then got on to how I got into debt in the first place and she made me feel like poo. Yes, I borrowed money at a time when I couldn't repay it because I had NO choice. I was off work sick, receiving no benefits, couldn't meet my existing repayments, so the only way of feeding myself was to use credit. She told me that I was irresponsible to have used credit when I couldn't repay it. She told me that's not how credit works. She spoke to me like I was 5. I told her she was being horrible and she raised her voice and told me that she wasn't being horrible ..... and then it was all a bit of a blur as she started getting really personal so I put the phone down and burst into tears.
I am doing my absolute best to get this mess sorted. We've made all our payments on time. We're sticking to the budget and I'm hoping that next year I can pay myself more, so fingers crossed we can increase our repayments or even come off the dmp and go back to repaying them normally.
I'm so upset about the way she spoke to me, and now I don't know if they're going to apply for the charging order of if they're going to sell the debt to a third party. They'll be taking whatever action they deem necessary tomorrow.First DMP payment (Payplan) February 2007

Firstly thanks to all that have replied to me, it has been comforting to say the least and I now know that I am not alone in all of this.
I have recently posted and have a separate thread re my interview with payplan this evening at 8pm. Sounds pathetic I know but I am really nervous about it all I have over £60,000 in debt and by my calcs should have between 800-900 a month to throw at it.
Can anyone tell me what to expect or any tips to be super organised? Or even their experience of payplan. I do have a separate thread re this as wasn't sure where to post it.
Just wish the day would pass to get this over and done with!0 -

I must be honest I don't know the first thing about charging orders so am buggar all help to you at all!
Can they actually do that if they've already agreed to a reduced payment...?0 -

I just set up a file initially with a tab for each creditor with all correspondence behind each section ... once you're set up with payplan you'll receive next to no letters. But when I did receive them i forwarded onto payplan and kept a copy for myself.
Personally I didn't deal too well with payplan (my own fault for being a control freak i think and needing to know everything) ... I got wound up that they were taking money from me on the same day every month without fail yet payments to creditors were not consistent, therefore I would still receive quite a few letters and in turn accumulate arrears which only increased my remaining balance!! ARGHHHHH!
I found that when I tried to contact them I had no response and finally had enough so decided to run with my own DMP which is going well. I know exactly who gets paid when and if theres a problem I ring the creditors direct ... it works
Having said that, I know a lot of people on these boards deal with Payplan with NO problems whatsoever ... so again I put this down to a personal preference.0 -

They had never formally agreed to the plan. They stopped adding interest but have been badgering us for extra money all along - we kept referring them to Payplan and explaining that we just don't have the extra money to give them.First DMP payment (Payplan) February 2007

Have you spoken to Payplan Ashden? Take some advice from them on what to do ... or they may contact Abbey on your behalf?0

Ashden these people are bullies, please don't get down about it.
They were irresponsbible for lending the money and now they have come unstuck.
Everything you said in your post was true, it would be unfair to other companies to pay its pro rata and they know that, I would not speak to them again they are not worth your precious time!
Speak to payplan and see what they say it could be just bullying and they won't do the charge order or it could be they do - if they do and you move then they have to be paid I believe if you stick there for years then you will pay them off before its a problem!
Stick to your guns and lets hope that smug bully woman is in debt herself.
Also everyone will groan here I would write an official letter of complaint about the way she dealt with you. Have a butchers through this link and keep it for future use http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf if you can find a reason to lodge an official complaint to be honest you stand a better chance of them giving in and not doing the charge at all. So when you have time read through it and see if you can get the !!!!!!s at there own game!0 -

The Payplan number rang out to answer machine so they must be really busy.

Well there you go girl send it with FORMAL COMPLAINT in bold at the top recorded delivery and tie your reasoning up to the document I send - quote it!
Sorry I sound bossy but sometimes we think we have to do what these companies say - I say -NOOOOOOOO they have to abide by guidelines and we do have power, make sure you go right through that document would hate you to miss something you could throw at them!
