Hi, You say HSBC seem to be making an offer after 8 weeks, when does the 8 weeks start from? Is it from when you first ask for a statement, or when you send the first letter? Thanks Lacey

    hi willenhall & desperate lou,

seems that hsbc start counting the 8 weeks from the day the 1st letter requesting a refund is put on their system, I sent my letter on the 5th march and they had it on their system on the 8th of march, I was all fired up to still to the timescales on this site but unfortunatly due to financial constraint i couldn't anyway when i was in a position to push on i realised it was 7 weeks and reading the threads hsbc did seem to be making offers after the 8 weeks unless it was at the court stage the they seem to get their hard heads on... so thought i'd leave it another week then foned them at the begining of the 9th, and lo and behold they said an offer had been sent and i recieved it two days later, foned them after recieving it to say was not happy with offer and eventually negotiated a figure and i'm just waiting for it to be credited, only did the 1st letter requesting refund.......

Obviously it is your choice as to which route you go but this was my experience of HSBC

    Hope this helps...
  • hi there,
    just a little query!
I sent natwest the second letter asking for £994 of bank charges on thursday the 10th may, giving them 14 days to respond and as of yet i still havent heard anything, also i forgot to put my telephone number on the top of the letter so will that add extra delay in them contacting me.
Do i send another 2nd letter of would it be best to phone them?
Any advice would be gratefully recieved.
Has anybody had any problems with getting there money back with Natwest?

I TOO AM WAITIN TO HEAR FROM HSBC, I SENT LETTER GIVING THEM TWO WEEKS TO RESPOND, AFTER WAITING FOR BANK STATEMENTS FOR SIX WEEKS. THEIR TWO WEEKS WERE UP LAST WEDS SO PHONED THEM, THEY SAID THEY HAVE EIGHT WEEKS FROM WHEN YOU FIRST SEND LETTER, NOT SURE IF I SHOULD GO WITH THIS OR TOO PROCEED WITH SECOND LETTER REGARDING TAKING THEM TO COURT, IN THEIR ORIGINALL LETTER THEY SAID THEY WOULD INVESTIGATE AND CONTACT ME AS SOON AS THEIR INVESTIGATIONS WERE COMPLETE, BUT WHEN I RANG THEM THEY SAID THEY HAD EIGHT WEEKS, WHAT SHOULD I DO:eek:

Check the HSBC thread for people in a similar position. 8 weeks after your first letter asking for charges back does actually seem to be the norm. Up to you both how you want to proceed. A lot of people are saying stick to your own timetable rather than theirs which is true. Your more likely to get it all if you go down the court route, but it looks like you will receive an offer after 8 weeks, although it may not be all you want. Everyone going throught the process with HSBC is in the same position
Wage Day Advance, Quick Quid, Pounds to Pocket and Pounds Till Payday....i'm after you
  • Can anyone help me i am in the process of court proceedings and ABBEY have offered a defence so the matter has now been refered to my local court.
we have been waiting for this questionair and a court date but the court has now written to me saying i have not paid £100 realocation fee we where not aware that we needed to pay anymore money has we have already paid £120. can anyone give me any advice????

So, you have received your 6 years of bank statements. You have a lot of work to do working out the charges.

HOWEVER, you will see the charges, the £28-£35 charges.

Then study the terms and conditions you have with your bank. You will not find mention of the £28-£35 charges.

Once you have totalled the amount, before you write asking for it back, write and tell them that there is no reference to these charges in the T & C and ask for a full explanation and a breakdown of the charges, give them 7 days to reply. If after 7 days they have not given you the breakdown, then write asking for a full refund and refer to the fact that they have not provided you with the information requested.

Will they give you the breakdown ????? That's why they do not want to go court. The chances are that they will be wise enough to understand what you are saying and refund without the stalling methods of "see you in court"

Hiya, I am now actually working for the same bank that I am claiming sme charges from (these occured before I actually started my job)... anyway... I applied for statments (last 5 years in scotland) and once I had the details of the charges I sent in my letter applying for the refund of the charges. I hadnt recieved any information from them so I sent in the second letter allowing them 14 days before I would apply for court.. I recieved a letter a week later saying that they have looked into this and they have decided that the charges are fair etc etc.... I then phoned them and discussed the matter and was told that all they can do is look at the matter again and then I may be made an offer (also, I have heard the the OFT now allows banks to take up to 8 weeks to deal with bank charge applications). I am meant to start the court case this friday but am unsure whether to wait until they get back to me again or not.... any ideas??

Depends which bank it is, some will make a reasonable offer in the first instance. Its nothing to do with OFT but the Financial Services Agency that all financial institutions are governed by that give them 8 weeks to resolve a complaint.

Check the thread pertaining to your particular bank, you'll find links to them in the Reclaim Help Thread which is linked in my signature, for other user's experiences with your bank.

    Hi,
I am trying to claim £609 thru MCOL from Abbey, (Abbey have just put in their defence). They have paid £110 as gesture of goodwill into my account, but I am intending to carry on with court proceedings for full amount. My question is do I need to send copies of any correspondence to the court as well as Abbey? Also, do I need to write "without prejudice" on the letter?

    Any help would be appreciated.
    Thanks
