    At this stage it all depends on how much of a backlog there is at the court. It's the court you are waiting for now, not the bank/solicitor.
    The last communication from Abbey was a copy of their defence, does anyone know if it may be beneficial to contact Abbey to ask if they would consider a settlement figure? If so does anybody of a number to call?

    You aren't likely to hear from the bank just yet as they know the current stage is just a waiting game, it suits their purpose to wait. Once things start hotting up you will receive settlement letters from them. If you write asking them for lower figures they'll deem you to be a weak-willed claimant who's no good at playing chicken, accordingly you will be offered a lower than you are entitled to.

    Does anyone know if the MCOL site asks for a named person as defendant or can you just put in the bank and branch address?

    Please can someone tell me if i understand this correctly.

    I am now up to the stage were the bank have defended my case. (14 May).

    Does that mean that they have now 28 to settle or it goes to court?

    If it does go to court how far will the date be away?

    Hi - I'm new to posting but have been following this site for some time and used Martin's templates to start reclaiming charges. The trouble is, I wrote to HSBC on 31st March asking for previous statements (+£10 cheque) but have not received anything yet.

    I phoned on the 12th May and was told there is a backlog but they'd do what they could. Today, still nothing so phoned again. Was told that 40 days will start from 12th May, not 31st March. Surely this is not right? I've already written to IC but they must be snowed under with correspondence so no reply from them either.

    Can somebody please tell me what my next step should be?

    The banks are allowed 40 days to provide the information so they have till 21 June by my reckoning. If you havent recieved anything by then, get on to the IC again.
    It sounds like normal stalling by the bank (they all do it) ..... I'v only had 2 replies from HSBC since Feb 6 ....... now awaiting court date ..... will keep you all posted.

    You put the name of the bank and the head office address.

    Hi Guys,

    I had 2 claims

    RBS Claimed £1037...Won £1037
    HBOS Claimed £3342...Won £3000...too long to wait they took every oppertunity to make it go on and on and on original offer £2000 called them and settled over the telephone for the £3k in less than 10 minutes...

    My advice do not give up ever ever........

    Anyway looking for some help.. I am about to re-mortgage and i am clearing a secured loan with Black Horse and also my previous mortgage.. Can i also make a claim on any charge i have incurred with these 2 companys since i have been with them and is it the same process.. Ask for a copy of all the charges and then send the 1st letter with a few editing on the letter.

    Thanks Everybody that helped me in the past if it was not for this web site i would never have got over £4000 back in bank charges...

    After 2 successfull claims from Natwest and RBS I am trying to help my sister claim from Lloyds TSB. Initially they were very helpful and even sent the charge details and amounts through rather than the statements. I sent off the letter asking for the money to be repaid, with a copy of everything attached and after some time they wrote to say they didnt agree etc etc and that was that, oh, and they would give until the 6th June before closing the case!! My sister has tried ringing a range of numbers as she replied to the letter saying it would go legal and to nominate solicitors, but always gets put through to a mailbox and is unable to leave a message!!!!

    What should we do now? just issue the court proceedings??

    Been following this forum for a while, however this is my 1st post, so please be kind to me!!
    Sent off my £10 cheques and letters re statements on April 12th, but have not heard anything from Barclays Bank or RBS Advanta credit card. I didnt send them recorded delivery as i only thought of doing so after i'd posted them. What do i do now as the 40 days was up last week, i was thinking of ringing them, but i dont know where to ring and they will probably say they havent received anything. Do i send another request by recorded delivery to them, thereby starting at the beginning again?
    Also Yorkshire Bank have sent us a letter acknowledging our request, but due to the high level of requests, will not be able to supply info by the deadline and they state the 40 days starts from them cashing the £10 cheque, (which they didnt cash until 23rd April) and they realise would could report them to the information commissioner and ask for our patience. What do we do now? If we repeort them and it went to court it would look bad on us, i dont mind waiting, but how long, they could do this indefinately as they have not stated how long it will take.
