they keep telling us that we must clear the overdraft, and
bring the account up to date
We are getting these phone calls now on a daily basis
had one today @ 1.06pm When i told the guy on the other end off the phone
that the acc't was in dispute and when it was setteled i would bring the acc back in line he said very abruptly " we will continue to hastle you untill it is paid" (IE the overdraft) It upset my partner that much because she answerd the phone that i had to take over the phone call

PLEASE can someone tell me iff they can get away with this as it now is upseting us both these constant calls even at 8 pm at night

I had the same problem of harrassment immediately from Barclays when I
wrote polite letter requesting refund of unlawful charges. I I didn't mention court proceeedings . In response to my nice letter they took away my debit card when I was checking the balance of my account.Th then sent debt collector to collect my cheque book. When they were earning huge charges
they allowed me to go way way above my overdraft charges with no redress.
The overdraft I had at the time I wrote the polite letter was relatively small
to previous overdraft levels. I immediately issued court proceedings MCOL
and won by default. Warrant was issued. Paid for execution. two months later
no warrant of execution. I have not access to my account. I am in extreme
distress because they cancelled my direct debits. When I received judgment by deafult they wrote instructing me that they could have the case set aside but they dd not want me to have to go to court. They asked me to instruct
    the court that
I would take back the warrant and they would pay the money into the account to which I have no access. They still haven't paid more than a month after the warrant of execution. I claimed interest as per Martin's
advice at I think 0.2l% or some other figure I cannot remember. Can someone please advise me what is the interest amount per day from Judgment default and actual payment from Barclays. Thanks.

After i had reclaimed £1441 in charges i am trying to close my account been to the bank the day after all the charges had been put into it was told i have a cheque outstanding so i could not close it.
Went again on the 30th of April (day i get paid) withdrew all available funds that the casher said i could but i have a charge of £34 to come out the next day so i left £35 in my account to cover this, Casher said i would get a cheque for the outstanding balance(£1) in the next few days and a letter of confirmation of closure of the account gave them my bank card and chequebook aswell.
Got a letter 2 days later saying i am £166 overdrawn and i could not close my account until it is at nil what the casher had done is paid me my overdraft of£100 as well as my funds phoned the bank to investigate and they dropped charges of £62 just by a phone call now the casher is saying that he didnt say there were any outstanding charges on my account when i withdrew my money and i will have to pay the outstanding balance.
Problem i have got is i get paid this thursday and i need to withdraw all my money and put into my account for all the bills to get paid but with no card or chequebook how will i do this i am willing to pay the outstanding balance so i can close my account (will just reclaim my charges again£450 so that will cover that ).
    Any ides would be helpfull:confused:

Barclays are NOT a professional bank. The law on harassment protects YOU against this. The next time you get one of these phone calls, firstly get the persons name and secondly tell them if they harass you again whilst your account is in dispute, you will report it to the authorities.
If you can get the persons name, write a letter headed "complaint" to their head office and warn them that any further harassment will result in seperate legal action against them

  • Hi, You say HSBC seem to be making an offer after 8 weeks, when does the 8 weeks start from? Is it from when you first ask for a statement, or when you send the first letter? Thanks Lacey

I TOO AM WAITIN TO HEAR FROM HSBC, I SENT LETTER GIVING THEM TWO WEEKS TO RESPOND, AFTER WAITING FOR BANK STATEMENTS FOR SIX WEEKS. THEIR TWO WEEKS WERE UP LAST WEDS SO PHONED THEM, THEY SAID THEY HAVE EIGHT WEEKS FROM WHEN YOU FIRST SEND LETTER, NOT SURE IF I SHOULD GO WITH THIS OR TOO PROCEED WITH SECOND LETTER REGARDING TAKING THEM TO COURT, IN THEIR ORIGINALL LETTER THEY SAID THEY WOULD INVESTIGATE AND CONTACT ME AS SOON AS THEIR INVESTIGATIONS WERE COMPLETE, BUT WHEN I RANG THEM THEY SAID THEY HAD EIGHT WEEKS, WHAT SHOULD I DO:eek:
Its been the longest three months..... success is nearly insight:T ....... Money in account

    Bank apology for charges letter

The Alliance & Leicester says only a few letters were sent out
The Alliance & Leicester (A&L) bank has apologised for a letter sent to customers who are trying to reclaim overdraft charges.
The letter cited last week's favourable court ruling for Lloyds TSB in which that bank won a judgement in Birmingham county court
