Reclaim Unfair Bank Charges article discussion Part II

I'm on income support as lone parent. I get in total £98 a week.
First natwest took £76 in charges cause a check bounced twice because of i was 7p sort for that cheque.
I borrowed money of my mum to pay bills so the week after i paied my mum some back and tried to pay bills.
When natwest finally took charges (which i did try to cover but when you have a son in hospital and you have to travel its hard) it sent me over drawn once again. So i went to speak to the bank and they put a over draft on for me of £200. Very nice of them. Very stupid of me but i took £150 to cover bills i missed because of being short the preivous weeks and pay my mum some more money back.
I was charged again and so on so on.... Now in total the bank has took £1654 in charges
I won't go through all of it but anyways now im £380 on a overdraft and the bank is still taking charges and i have depts everywhere.
I rang them up to claim my charges back under FH. Got letter after 2 weeks off phones calls and such posted that last week just waiting to hear. I'll keep you updated0 -

Hi this is my first post on here just after some advice, I have tried to claim back £4025 worth of bank charges and it had gone to court which was stayed in September 08, I have since applied to LTSB to consider my claim under the financial hardship rules, sent off income and expenditure form recieved a letter back on the 18 march from solicitors saying they have passed it onto customer services. Havent heard anything since then so decided to ring them today they said they hadnt recieved the form and so would send me out a new one today. She said that TSB would not look at my hardship case but would help me with my financial difficulties (whatever that means) and that my court case is still stayed and it cant be lifted. I decided to ring the court today to see if it could be lifted and a lady told me Ican apply to the courts to have the stay lifted under the financial hardship rule but it would cost me £75 and she wasnt sure if the Judge would rule in my favour. What I need is some advice does anyone out there know if you can actually have the stay lifted or not as I really cannot afford to lose £75. Any help would be gratefully recieved0

Stick to going through the bank, its very unlikely the court will lift the stay on hardship grounds.
Did you keep a copy of the original form ?LegalBeagles0 -
Hi yes I have kept all correspondence between myself LLOYDS and the Courts. I am really cocerned that LLOyds wont help at all and Iam £2125 = 2 months behind with my mortgage as well as behind with utility bills. LLoyds do continue to apply monthly charges to our account so it is just becoming a vicious circle.
Do you think I should apply to the FSO to see if they can get LLoydstsb to change their mind.
I do work so does my husband and we have 2 children, but there isnt enough money coming in to cover the necceties never mind any luxuries.0 -

I have claimed financial hardship nearly 3 weeks ago but have still not heard back. I know I am hardship but will this mean I will get my money back?
I am trying to claim over £900 in charges and interest and really need it as owe so much money to my landlord, friends and family who keep having to help me out.
Hi,
It took my bank 4 weeks to give a response (unfortunately for me, they turned down my claim. It is now with the FOS) so I wouldn't write another letter just yet.0 -

When the IE form arrives, complete it fully, and send evidences of your arrears/any threatening letters etc back with it with a letter detailing your circumstances, be emotional if you like, just not ranty (if you know what I mean) - just make it clear the effect them not refunding enough to pay off your mortgage arrears will have on your family - and tell them they can pay direct to the mortgage co.
Also ask them to stop future charges, and think about shifting to a basic account and cancelling DD's etc and paying by cash etc for a while till you are a bit straighter. Also have you posted in the debt forum for help with the rest of the debts?
Yep its galling kind of begging to get your own money back, but Lloyds are utter turnips when it comes to hardship claims.LegalBeagles0
