Has anyone had any luck with the Cooperative bank? I've had four £19.50 charges as far as I know.

    1. As far as the bank is concerned you have £10,000+. If that is financial hardship, your definition is worlds away from mine.

    2. You can move the money, but you still won't be in financial hardship. Banks aren't totally stupid

    3. You can, but the claim will be rejected under FH grounds so you're left with waiting for the OFT test case to conclude.

    thanks for the help

i appreciate that some people will think i have a cheek to claim but the money is not mine, it was just being kept there and if i was to tell you more about my circumstances you might be inclined to agree that i have financial hardship, its just that there is one "oddity" in my case.

and finally, i take it the two claims wont compromise each other then, i.e. if hardship gets rejected then the other one will stand as normal.

See page 11 for FSA Waiver Directions on FH here:
    http://www.fsa.gov.uk/pages/Doing/Regulated/Notify/Waiver/pdf/disp_monthly.pdf

These are the sort of things that banks look for when deciding FH

    Financial hardship
    Reduced income/loss of job
Level of priority debt arrears against free income available
Utility arrears such as gas/electricity threat of being cut off
    Mortgage arrears
    Council Tax arrears
    Credit card debts
    Repossession
Serious health issues both physically and mentally
    Threat of possible suicide
No money for food or rent

You should include an Income & Expenditure sheet See here:

I think i know the answer to this but best to check..

    I did a claim back in 2007...

Am i still able to make another claim? I would not be claiming anything i have already claimed and recieved but since my original claim there has been approx £400 that i can claim back.

    Can i do this?

thanks, i was aware of that.

however you said earlier that the banks will obviously have a record that i had that amount

could i not argue that since i qualify for hardship on other grounds and the money is no longer there in the account then i am suitable for hardship, or will they want to know where the money has gone?

has having that amount totally ruled me out for hardship period?

If £10,000+ is in an a/c in your name, then it is not unreasonable for a bank to assume it is yours.
will they want to know where the money has gone?
A fairly obvious question I would have thought, wouldn't you?
