Reclaim Unfair Bank Charges article discussion Part II

First Direct has acknowledged that I am in financial difficulty (don't there if there is a subtle different between difficulty and hardship) but say that because they don't consider that my financial difficulty is as a result of their charges, they won't do anything until the outcome of the case.
I'm trying to reclaim £1700 without interest.
Is this their standard stance, and how do I respond to it?0 -

Do you have priority debt arrears?0 -
Hi
I'm claiming Financial Hardship as i'm on an IVA which i have defaulted on and am probably going to have to be made bankrupt.
What i'd like to know is when i sent in my income/expenditure form i attached the final demand letter from my IVA provider. If Natwest decide i do qualify, are they likely to credit my Natwest bank account or are they likely to send a cheque to my IVA company, in which case all this hard work will have been a total waste of time, as i'm prepared to go bankrupt?
Thanks in advance for any advise given0 -

To be blunt, if you are in severe financial hardship who cares where the cheque or payment goes if it alleviates your hardship.0 -

What i meant was i'm prepared to go bankrupt as i have wasted nearly £8k paying an IVA company what i thought was money that was going to reduce my debts, when in fact i was just lining the IVA advisers pockets with my hard earned cash. I should never have been put on an IVA because i dont own any property so i should have been made bankrupt instead.
As i don't intend on paying the arrears of the IVA, simply for the above reason, then if Natwest agree to repay me i hope they dont decide to clear the IVA debt???0 -

No priority debt arrears now (but did have before going onto a DMP with the CCS in December 2006).0 -

Amount Claimed: 4500.00 + interest
Amount Awarded last week: 7180.00
Started claim in January 2008. Put in claim for four and a half thousand pound, plus interest. Was told my claim had been filed and would be dealt with after High Courts decision
November 2008. Got behind with mortgage and bills. Wrote to them claiming financial hardship. Received letter offering me five hundred pounds as a final settlement...LOL I told them where to go!! They then asked for a financial statement to be filled in.
I received a letter stating I wasn't in their opinion suffering financial hardship!! I decided to leave it until the high courts decision.
Out of the blue last week got a letter offering me 7180.00 as a final payment. I rang and accepted within minutes!! Got the money deposited into my account the next day. From talking to the lovely lady (she must be a one off) at Natwest to accept my offer she gave me the impression Natwest are expecting to have to pay out on all these claims sooner or later!!
Thank you so much Martin for bringing this to light for us all. My children will now get a holiday this summer!!
Just waiting for Halifax to respond now!!!
Good luck everyone, I never thought I'd get my money back but in the end I got more than I ever expected!!!

Has anyone had any success at getting an interim payment from Lloyds?
At the moment, they seem to be adding silly charges to my account on a daily basis.
When they've given you a payment, do they then close your account?0 -
I've just been charged £51.54 by Abbey for going £2.47 over my overdraft limit for two days!
£25 monthly overlimit fee
£25 paying out a direct debit that took me over the limt
£1.54 interest on the £2.47 (2 days)
Does anyone else think this is unfair???
If they had have bounced my direct debit instead, I would only have had one fee for that, £25 !0 -

Has any one had any luck with this bank.I posted my letter off middle of February 2009 still no reply.asking for statments and copy of loan agreement still no reply all these letters were posted by special delivery.
Do you think it is wise to follow up with the FSA?
Also I had my bank charges returned to me from Abbey and they only refunded me some of my money back.they too said that as the account was closed I would have to wait till after the court case!!! is this right.?
I too have written back to them with a complaint as I was given my money back under financial route and I feel it is unfair for them to withold some of my moeny.any comments?0
