    Not the full amount but I started my claim early last year and about a month ago I re-opened the claim under the hardship rule. I got a letter last week offering me £30 (!) so I called and asked for it be increased. The lady I spoke to said that Barclays have a formula (they will offer something like half the amount accrued in charges since you entered hardship) So I was offered £500. I appealed to her better nature (saying is there any chance you could offer a bit more... it's Christmas soon!) which worked as she increased it to £722. It was transferred into my account the following day so Yay! Happy Christmas!!

    She also said, the rest could be refunded according to the outcome of the test case, when it is concluded.

    So - it's worth calling up if your original offer is a bit low.

    well on it goes...........letter from lloyds tsb this morning reiterating the test case AGAIN, and telling me there's no point in writing to them again. They go on to state that ' the FSA has agreed for now to allow us to suspend the normal timetable for dealing with complaints about unplanned overdraft charges'
    It then goes on to say 'We are still looking into your concern regarding to your financial hardship element. We have sent your concerns on to our Customer Post Team in Andover as they are the best people to help you'

    Which is basically back to the brick wall...........
    Considering the mess i'm in financially, and they are well aware as they have had to lower my repayments on all my borrowings with them ( 5 accounts ).
    so yet again it seems to me that they are passing the buck.
    and I believe they are going to create the new 'superbank'?
    Britain's most (mis) trusted bank !

    I'm currently on an IVA and wondered if this would warrant me to claim under the 'financial hardship' banner, as afterall, i'm on the IVA because i'm in financial difficulties?

    Wondered if anyone else had done this and what was the result?

  • Hi all - newbie here with a question (sorry if this has been answered before - I did do a search but couldn't find anything)...

    I have a claim in for a relatively small amount, and I will be leaving the UK permanently in around 8 weeks - does this give me any special dispensation to hve my claim sped up? And if so, how exactly would I go about that? Would I need to write a letter to the court explaining the situation, or is there some other procedure?

    Thanks in advance for any advice!
  • I'm new to this reclaiming business & have a query. I've just heard back from Barclays, but they haven't itemised my charges over the past six years - they've just sent me a list of annual totals. What should I do?

    First of all, an admission: I am hopeless with money. But I'm turning over a new leaf and 2009 will be the year I put it all in order.

    I am so hopeless that when I first realised I could reclaim bank charges I felt incapable of going through with it myself and engaged a conpany, Bank Refund. They put in claims with NatWest for charges on my personal and business account. A stay was put on the personal account but NatWest made me an offer on my business charges and I got £800 from them. However, I had to pay Bank Refund £200 of that.

    The stay is still on my personal account, but I believe I can claim due to financial difficulties, which are legion -- including my husband going into retirement due to disability, and many debts. I believe, having found this website and forum, I can and should go it alone. But Bank Refund has all the paperwork, inclding bank statements up to the time the stay was put on the process. I signed a contract with Bank Refund, but I can't remember the terms and can't find my copy. Bank Refund tells me that the charges on my personal account amount to around £7000.

    Can I just go ahead and approach the bank myself with a claim due to financial difficulties, or do I have to ask Bank Refund to do it for me?
