  • Is there a template letter for claiming Financial Hardship? I've looked through the article, but can't see a link to one.

    Otherwise, does anyone that has had success with claiming financial hardship have any guidance on what specifically should be in the letter?

    I bank with Lloyds TSB and have an outstanding claim pending the usual court decision, but the charges and pressure I'm under financially while they sit on the £8k I'm claiming are crippling me.

    Hi, if you go to Martins reclaiming guide on here there is a template letter for reclaiming charges and it mentions financial hardship, just put bits in and take bits out so it's personal to your own circumstances.

    Hello its me again, l did a letter yesterday for FH and just included copies of all arrears for mortgage, electric, council tax etc, just gather as much proof as you can to include with your letter. lf we could get ours back it would really help us out but they cant seem to grasp this concept can they!

    Hi mortphilio, Nova's advice is spot on. Also am dealing with LTSB myself and they have been a nightmare. I sent letter after letter about financial hardship, even visited my local branch in person only to have the bank manager laugh in my face and tell me 'financial hardship waiver? i've never heard of it' he was most intimidating. I was so angry I had to sit on my thoughts for a few days to calm down. when I eventually calmed down I sat down and typed a letter. It took me over an hour to gather all the relevant facts (found most of what I needed on this site) and when I'd finished I had in fact astonished myself. The result so far? I had a phone call from a lady at LTSB offering to assist me with reductions in my loan and o/d repayments and my husband's loan (by the way i'd been practically begging them for months, at one point totally humiliating myself by sobbing uncontrollably down the phone to no avail). The next thing is I get another letter and instead of the constant 2-3 page reiterations of the test case it was just a few short lines to tell me that they would be back to me with a decision within the next 4 weeks!!!!
    so the message here is get armed as Nova suggests with as much stuff to back your case up and if you still get a 'nil response' then you need to get heavy. If you need any help please feel free to pm me.
    and have just been delighted by the way to report a success with my neighbours charges that I have been working on. £1553! details are on the success page.

    Hi everyone,
    I've already got my statements from the last 6 years and highlighted all the relevant charges. Do i send all the statements back with the 1st letter or do i just insert all the dates and charges into the calculator on this site then copy the that onto the letter?

They have also changed my account to a basic account and will not apply further charges to my account until the appeal/results of the test case are known. I received a call two days later, as promosed and informed they will refund all charges (minus interest) for the past six years and a letter would be sent to me. All I have to do is agree the amount on the letter and the charges will be returned. I am waiting for the letter at the moment.

    I shall add to success stories when I have more information

    Question ; Has anyone managed to have a refund of their MCOL and allocation fees by the bank - or interest for that matter?

    In my response to the forthcoming offer letter, I have been advised to add something along the lines of accepting this amount (without prejudice) and having the right to claim the full amount (interest and court fees) when the test case is finalised - Any advice?

    Yes if lm right if youadd without prdudice to your acceptance letter, ten lm sure you can go on to claim the rest after the court decision.
    Check on Martins guide on the main site l've seen something about this on there.

    After reporting just 2 days ago of the reclaiming success with my neighbour's hubby's charges, she has now recieved an offer today of a whopping £3123 for her own charges. Which she has obviously accepted and this now means she can repay her mortgage arrears in full, stay in her home and have a little left for a rainy day. I am over the moon and it couldn't have come at a better time for her.

    A big thank you once again to everyone on this site, especially Martin for making us aware of this and helping us all to reclaim what is rightfully ours.

    Thats so brilliant, how lovely of you to do that for your neighbour, I bet they're having a lovely nights sleep now thanks to you. Well Done You! X

    thanks nova. she's a perfect neighbour and has been more than a friend to me so I was so glad to do this for her. It was getting so close to the wire for her with litigation and all. we were all wondering if she'd still have a home at christmas. well thank god she will now.
    I have a case pending with Lloyds and hope I get some success too. If I get it back they won't pay it in cash but allocate it back to other accounts but i'm fine with that. at least it'll be more debt paid.......

    Good Luck with that then moo cow, we have one pending with nationwide l've a feeling that if they repay anything it'll only be half, just enough to clear the OD or they''ll use it towards the CC, they'll do anything but let us have it!!! But hey fingers crossed!
