    Thanks WVM :D, so do I resubmit my claim from 2007? or do I just add the charges incurred since as I presume they still have my first claim on file "awaiting the court ruling" ?

    And are all you experienced MSE's still saying go down the court case route and they will cough up before the court date?

    keep adding them on, they will have a record of your claim from 2007 thats for sure.you can always send them a reminder to let them know you are not letting this rest and at the same point you cant point out the other charges you have had since.

    as for going down the court case route...im not sure on that one as it was just over 2 years ago when i had a big battle with Barclays and it was a lot easier then as only tens of thousands of people were making claims and now there are millions on the band wagon.
    As far as i am aware a very large number of courts are not dealing with cases untill a desission has been made...but dont quote me on that one tho...im not 100% sure on that one.

  • cheers WVM7, If I were a judge I would seriously consider the fact that they have paid out to thousands is an admission of guilt..... or else they will have to ask the ones that have been refunded to repay!

    yeah, but the best thing about it is that all payments from the banks were made "as a gesture of good will" and they cant ask for the money back as no court 'forced' them to pay out:D

    i agree, the fact banks have already paid back thousands of people's bank charges shows the banks dont think they are as 'fair' as they argue they are now in the test case. the very reason they call the payouts 'goodwill gestures' shows they are unwilling to admit liability though, even though they are paying out. some banks are even lowering charges now, so that too, seems to me, an admission of guilt concerning the fairness of the charges.

    need help in deciding what to do next please .

    I wrote to Capital one for my charges back £400 charges £576 with interest. i got a letter saying they would refund £160 charges and £10 interest which is the differance between the charges now , as a goodwill.

    I wrote to then saying i wanted it all or i would go court to claim the money they have sent a letter saying they will not consider refunding anymore £170 in there final offer .

    £170 isn't even half the charges

    Shall i try my luck and ask again or take the money ???

    Take them to court or the FOS. They ALWAYS pay out in full, without a fight.
  • :confused: Hi all due to the fact that i was flooded last july,and have just moved back home ,have not been able to keep up with events , my claim was stayed untill the end off the test case ,which i asume is still going on, i have not herd from the court, i have however recived a letter from barclays saying that they have droped there charges from £35 to £8 , if this is not an admition off guilt that they have been over charging i dont know what is ,should i apply to the court for the stay to be lifted?????? will the judge see this in the same lite as me any advice would be appreciated . also do i keep adding the interest to date ,my case was stayed on the 21/8/2007

    Hi all.
    Around four to five years ago we had a bank account and loan with Nat West. When the bank account continually went overdrawn and the loan wasn't getting paid (bad time!:mad: ). Nat West combined the loan and overdraft and placed us on a repaymen plan. My question is, can I reclaim for any charges applied to the combined amount, or does this come under a loan agreement?
