  • The paragraph relating to financial hardship can be found in the template letter that you send off when you first requested the bank charges refund. As you requested this over a year ago, i would write to your bank stating that you have already received confirmation that your request has been received by them and you have been informed that you have to wait for the test case result. However, now you are experiencing financial difficulties you need to use the paragraph from the template letter explaining why your feel that you fall into the financial hardship catagory. It may be helpful to include your SOA with the letter as they will probably ask you to do this later anyway and it will speed up your reply. Good luck
  • Hi, I was charged £50 for going overdrawn for 24 hours by £6.49 due to a DD. This is the first time ever so I used the template letter and they credited me half, £25. Should I be entitled to the full £50 and write back?

Has anyone had experience of claiming back bank charges more than once on the same account. I claimed over £1000 of charges back from the Halifax at the start of 2007 (before the test case started and all claims went on hold) and they paid up. I have since racked up several hundred pounds more of charges due to financial hardship. Can I put in a second claim for these recent charges? Has anyone else ever claimed twice on the same account after they were initially refunded charges? Thanks for any advice and experiences you can share.
  • Hi

Please can someone direct me to where I can find out about claiming finacial hardship and if I am qualified to and how I go about doing it?

Also can I claim financial hardship on my credit card claims and ppi claims?

Seems silly to ask but thought someone may have a clue as I dont sorry

    Many thanks

    :)
  • Another question sorry :o

Just about to send off for my information from Data Protection and have had a thought that I have moved a couple of times in last 6 years. Even though a Barclays and Nationwide account have not been used for at least last year really and lie active but not used I am not sure if I changed my address with them, can I just add in my letter you may have my records at a previous address (giving them that and my old surname)?

    Many thanks.

    :)

Hi, can anyone give me some advice?

I have had a Beneficial credit card since 2001 with my other half as an additional card holder. I took out PPI however only realised in 2006 that it only covered myself and not the additional card holder. Pretty useless for us as we have joint finances. When I realised that the additional card holder was not covered I cancelled the PPI which they did no problem.

I wondered now if I could claim back the PPI I paid. I would never have taken it in the first place if I had realised it only covered myself.

Would this qualify for a claim?

Excellent TinTin. That's the first success story I have seen on this site with Abbey. Makes me feel better about my claim I submitted with them ages ago which is now on hold.
    Marie :)

It's the first one I have seen as well and I often check this forum for results like this as I have a outstanding claim with Abbey for £3,700 going back to March 07 when I filed it!
Anybody heard anything from the Abbey on their claims?????

    Hi All.

Wonder if one of you knowledgeable people could give me some advice or point me in the right direction.

Am trying to claim business bank charges in the reply letter to me the bank has stated

"You may also be interested to know that the Unfair Terms in Consumer Contracts Regulations and Unfair Contracts Terms Act 1977, which are widely quoted in support of complaints that overdraft charges are unfair, do not apply to you. This is because you are a business customer and the regulations and the act only apply to consumers".

Where can I go from here? Am not sure what to put in my next letter. Any suggestions would be gratefully received.

    :D

    Hiya scorpio31

It seems abbey are puttin up a good fight to not pay out. After me sending a pile of debt invoices and a covering letter stating i wish to claim under genuine financial hardship terms they stll refuse to pay. I started my initial claim for nearly £4000 back in june 07.Abbey dont wish to discuss the claim with me anymore as the final decision has been made.So they advised me to take it up with the Financial Ombudsman Service.More time for Abbey to sit back and have a good laugh and still carry on charging!  Keep us informed of any news regarding Abbey.
    Cheers!
