    Thanks for your help Tiggrae! will i stand a better chance of getting my full claim granted from the Abbey if i state i am in financial hardship then?

    Its thanks to Abbey that i am in this mess as abbey seem to see its more important i pay there expensive charges than pay my other debts and utility bills.

    They make me so mad!:mad:

    Hiya susie, im still fighting out with my claim with Abbey, altho after a long winded convo over the phone with someone from Abbey i told them i was experiencing financial difficulties and failing to pay my debts on time and incuring more god dam charges. Abbey told me to write a letter under financial hardship and explain why i should get my claim,along with some debt letters, apparently you stand a better chance of gettin your money back if you are struggling:confused: .But you have to be genuine as they may check up.

    I have just received a letter from barclays bank. As from August they are reducing their fees to £8. it states they will always return items unpaid if it will take you overdrawn or make you go over your overdraft limit. I think they are now worried that they are going to lose their appeal!!!!!!!!!!!!!!!

    Hi all!

    I have been a fan of MSE.com for ages, but have today decided to join the forums and ask for some advice! I've just been on my HSBC online account and I have a note on there to say they are going to take £50 off me on 27th July for going over my overdraft last month. Is this fair? & can they just take all that money? It's before payday & is likely to push me over my overdraft again! Is there any way I can stop them from taking it??

    Any advice would be gratefully received!

    Hiya indiebabe, ive been chasing after a big claim with Abbey since may last year and still fighting, altho i did get a statement through a couple of weeks ago with £300 worth of charges, i nearly died!:eek: I got straight onthe phone and demanded they drop the charges! The 1st offer was we can only take off £30 then i managed to stretch it to £168, i should have stuck it out to get the whole amount dropped.You to can do the same get on the phone and be demanding and dont give up.     Hey folks,

    Looking for a bit of advice. I'm making a claim for my charges against LTSB for my charges under hardship. In their 1st response they wrote to me agreeing that I was in hardship and they would get their Customer Support Team to call me to see what they could do but that until the court case was settled they weren't able to do anything.

    I relied stating that they had an obligation to deal with hardship cases and rasied my dissappointment that I hadn't heard from their Cust Support team.

    I've just recieved their response stating that my letter would be added to my file, that they can see i'm in difficulty but are still not progressing my claim of charges and that they will get their cust response team to call me. The letter was dated a week ago and i've still not heard anything.

    What should I do and what are the rules that they have to follow for dealing with hardship cases?

    Any help would be greatly appreciated.

    :confused: just wondered how long the process tookfrom you putting in your financial hardship case to getting paid out? sent my financial statement off to halifax with various copies of my creditors letters etc.. on 16th june ,have rang halifax 3 times in last 10 days ,they just say they ha ve recieved said paperwork and its gone to relevant dept for review :rolleyes: cant help thinking its just delay tactics, cant really afford to wait that much longer, lord knows we've all been waiting long enough !!

    soon as i get some news ,(fingers crossed for it been good) you'll all be the 1st to know

    Sorry to jump in on this but cannot trawl through all the posts..................are the banks now paying out for excessive bank charges over the last 6 years? I heard it was on hold until a forthcoming court case? Or are they once again reimbursing people?

  • Dad has been reclaiming his bank charges from the Natwest since last year.
    He has received 2 letters from the Natwest( that last being 2 weeks ago) saying that the claim is on hold at the moment because of the court case and giving him the date and information of what and when it is all happening.

    Toady he received a letter from a debt collect ageny saying that the Natwest have authorised a reduced amount to be collect within 14 days.

    When he called the company up and told them he was waiting on the out come of the court case the man told him he was quite aware of people trying to reclaim but they basically want the money NOW. My Dad told the man that he wasn't going to get it and contact the Natwest for information on the account, he said no as they don't have to prove he owes the money they just collect it. So my dad said take me to court then so now on his file the man has put happy to go to court. This could be a quick way of reclaiming the charges don't you think.

    How does this stand?

    At the end of the year a business fill out their accounts, any debts are offset via profits against tax eventually being written off.
    When these debts are written of over 1-5 years how can the company still reclaim the debt? Is there a tax implication against the company also.

    Should it not be the Inland revenue reclaiming the debt or a portion of the debt.
    My Mission today is to have an opinion on everything.
    If you don't like it well you will just have to lump it!
  • As defendant your dad will need to defend an action for charges, and apply for a stay on the basis of the OFT test case.
    Is it personal or business claim against natwest?
