Reclaim Unfair Bank Charges article discussion Part II

I e-mailed Lloyds TSb about reclaiming bank charges and was told they'd send me the last 6 years bank statements for a tenner. Surely, that's just another stupid, unreasonable bank charge?
Not really. You should keep your bank statements then you don't have to pay a fee. You have to expect a fee when requesting a copy of anything. It does cost paper, time, postage so a small fee is reasonable in my book.
But here is a tip. You can pull the charges off your account via the online banking service free of charge by using the search feature. This can't be used as official documents but will give you all the information needed to put a claim in.0 -
I am trying to reclaim just over £1000.00 in charges from Halifax and seem to be getting nowhere. I have used the template letters and told them I am having financial difficulties as I had to take a lower paid job, I am behind with my mortgage and have repayment agreements set up with various creditors etc but they just ignore my letters. What should I do next? They are currently hounding me with telephone calls for a payment of approx £80.00 (which I can't afford) as their charges took me over my overdraft limit. Any help or advice would be greatly appreciated
Hi debpos,
It sounds like you have followed the process correctly as laid down here. So the next step would be to pass the case on to the FSA stating that this case falls in to the hardship clause for them to look in to. It's not too hard to do as all you have to do is supply them with the copy's of the ongoing correspondence you have had with the bank in question. Just make sure you state clearly why you think your case falls in to the hardship clause.
On a side note. The way you have explained your situation sounds extremal worrying and I would point out that this claim might not solve all your financial problems. Have you been to your local CAB office and asked for a debt counseling service? It's totally free and they really can help you sort out your current problems. But you must act fast as the longer you leave it the harder it is to solve.
Hope that helps.0 -
Where a reclaim for bank charges claim has been 'Stayed' in the County Court, has anyone made an application in the County Court for bank charges NOT to be imposed upon that bank account until after the outcome of the High Court Test Case is known ?0

Hi there,
brand new to this forum so apologies if answered elsewhere.
After being with First Direct for 5 years with no charges, i have now been charged £225 in the last 3 months - £25 per day over overdraft.
This is due to an issue with my mortgage provider who took out more than i was told they would - but my debate with them seems to be going no where.
When i first contacted First Direct they offered to halve this, but i was not happy at paying £12.50 per day for something i feel was not my problem.
I wrote the first template letter, with the £10.
When i chased them they said they would put me on their list of customers waiting for an outcome from the court case. They also said they didn't charge the £10 for supplying me the summary of charges.
My question is, do i move onto the next letter although i have received nothing in writing, or should i wait to see what First Direct do when the court case is finalised?
I have a new account elsewhere that i can start switching my business to - is that advisable or should i stay with FD to use as a bargaining tool?
thanks for reading.0 -

as a sole trader my only bank account is a business account yorkshire bank have
replied to my oringinal letter saying i am not eligible to claim any one got
any suggestions please0 -
hi rather than wait for the test case to be sorted out - I'd go back to First Direct and ask them about their Direct Debit guarentee (ie someone shouldn't be able to take more money then you've agreed) I'd also go to your mortgage company and tell them you'll start a claim against them in the county court for negligence and you'll be claiming damages to the extent First Direct have charged you !!
My mortgage was messed up and when it was sorted they say they can take extra out in the first month - to my benefit they say:D
It is in the small print so struggling to get anything around that.
Should i move straight to the second letter?
I think they will just wait until the court issue is settled what ever i do.
