Reclaim Unfair Bank Charges article discussion Part II

Interesting. Are banks more likely to pay up now the original court case was won even though they're appealing?0
-
I am currently banking with nationwide with a FlexAccount that I believe does not allow you to go overdrawn. Recently I was £1.50 short of paying a standing order and Nationwide have charged me £30 for this. This is clearly a disproportionate charge. Can I send in a letter to reclaim this charge without actually paying it (so in effect I would just no longer owe the bank this money)? Would doing this reduce my likelihood of winning (as opposed to paying the charge, then trying to reclaim)? Also, is the bank likely to add interest to this charge, or further charges, the longer I don't pay it?0

Is it still the last 6 years only that you can claim ?
This was posted elsewhere:The FSA "stopped" the clock on the 27th April 2007 which means, in theory anyway, that in court cases in England, Wales and Northern Ireland, and in cases that are decided by the Ombudsman, you could potentially reclaim for all charges incurred from that date onwards. However, on another thread I started on this, no-one has conclusively said this is the case but reading Martin's article about the court case result, it does certainly sound as if this is the case.
Want to put my claim in ASAP so would like to know if I can go back to April 2001.
Thx0 -
I had a phone call today from a company called "Reclaim Today" who had reportedly been employed by the High Court to reclaim Bank Charges. They wanted a fee paid and as soon as I said not over the phone the call was ended. This was obviously a company just after my bank details - Beware.0

Sad to say that the limitations act will only allow you to go back six years from when you first put in a claim IN WRITTING.
So in your case you will only be able to reclaim from June 2002.
If you click on the link below you will be able to get more information on this website regarding the limitation act, plus much more information that may even help you out in the future.

Good luck.:TNot just a white vanman:cool:
I'm no expert in things really but i do have 36 years of experience in life, and some of those years fighting off bailiffs.
Nicknamed Victor Meldrew among friends as i love to complain;)0 -
That is something I was wondering too, as like so many people on here, my claim has hit deadlock. I'm at the stage whereby Barclays sent me a letter saying my complaint is logged, and that nothing will be looked at until after the text case is decided.
I'm wondering whether it is worth another letter to Barclays in particular? especially after they have already looked to rectify things by slashing o/d charges to £8..0 -
Hi
I claimed my bank charges back last year for our joint account and got back £3250. Ive just started the process with my small soul account and ive been told that all claims for bank charges are on hold can you let me know if you claimed for bank charges or PPI and what was the bank in question - mine is Lloyds TSB.
Thanks Kelly0 -

I know I have been slow on this but I am about to send off a letter to NAT WEST asking for 6 years worth of statments/charges.
Before I do so has anyone requested this info over the phone & got anywhere ?
Can someone please confirm the right address to send my request to ?
I got the address stated below from the thread set up for this but it says above changed 15/04/07 !!! Does that mean that is the correct address or is there a new address to send the request to ?
