  • Sad to say that the limitations act will only allow you to go back six years from when you first put in a claim IN WRITTING.
    So in your case you will only be able to reclaim from June 2002.

    Thx for that, I was hoping that the freeze that the OFT had put on in April 2007 would mean it was 6 years back from then i.e. April 2001 > now. Would have meant I could have claimed back an extra £1600 incl interest Suppose they've got away with that money now.:(

    Just a quick question following the high court decision.... if you have previously accepted a payout from your bank as a 'goodwill gesture', as they would never admit it was for unfair bank charges, can you make a fresh claim for the remainder or even the full amount again as they didn't accept what it was for??
  • Hi all im new to all of this so bear with me,
    i have bank charges with hsbc, i wrote to them on 28th april this year asking for my money back, they sent me a letter fobbing me off telling me that they were fair charges and that they would not give me any money back.
    well,
    i wrote back to them and asked once again for my money back and they told me that the complaint has been recorded and to wait until this business with the oft has been sorted and they will give me a full response.
    what i need to know is are they fobbing me off again or should i write to them threatening county court action?????
    please help

    Sad to say that at the moment that does seem to be as far as you can go.

    have you followed martins step by step guide to see if you may be able to push the bank if you are on means tested bennifits or low income?
    im in the same position as you and have just sent them another letter asking for a slightly lower amount so long as no restrictions or cancilation is placed on my account. i will let you know on here the result of that letter.

  • I like most people have had my letters in with bthe banks for some time, like most we are just waiting for the knod to get our money.
    Today i have just recieved a letter from my bank (Barclays) telling me that i have lost the case.
    Can anyone please advise

    whats the next step / letter if you get a NO from the back for charges refunded throught harship.

    How can i write and ask for back charges back just because i believe they are unfair. Even though i have had a no through Financial harship??

    Proves what i have thought all along - that the hardship rule was a myth, made up by the FSA, OFT, FOS and the industry - just to mislead the press into believing that poorer people were still being dealt with.

    Disgraceful, and the government seems blind to it, as it does not want to see more banks suffer financial difficulty, even if the voters do.

    Hi

    I made a payment to moneybookers by mistake from my A & L bank account. I got confused when making a payment as it still showed money from a payment I made the day before as being in my account - hadn't kept track of how much was in there so assumed it was correct. The second payment came back with a wopping £25 fee. Can I claim this back?

    I tried to claim back over £1600 in charges from HBOS last year. In July, I received a letter stating that they had put £888 into my account, but that this would be in full and final settlement. If I wanted to accept, to do nothing, but if I wanted to reject the offer, I should return the money and await the outcome of the court case. As there was a lot going on in my life at that time, I did nothing, and since then, have spent the £888. Does this now mean that I cannot pursue HBOS for the remaining half of my claim (plus further charges since then)?
    Any advice gratefully received.

    today From Halifax/Bank of Scotland. Yippee !!!!
