Hello, just been having a scan through all the great success stories. :D Are these bank paying out even though the case is still on hold?

I have logged a case with RBS & recently returned their form as i've asked for it to be dealt with due to hardship, following death of my partner. It's been a few wks since i returned it, no doubt my case is more complicated as the account is now closed & due to the death of my partner who the joint acc was with.

hiya, ive been chasing my claim with Abbey since may 2007, i was fobbed off with letter after letter, 1st one saying we are looking into your claim, then the dreaded testcase landed.Lovely letter from the bank then saying we are waiting till the end of test case before we look at your claim.Doh!!!

I am deep in debt struggling to pay debts and utility bills and my bank seems to sit back and enjoy watching me sink into debt.

I am awaiting a reply from Abbey now about me persueing my claim under financial hardship terms.

Anyone else had same problems and any good advice will be great

    Hi everyone,

ive read through the forums trying to get the answers that i need, however there are a few that i still need answering.

I'm trying to help my mom to reclaim back her bank charges with Lloyds TSB. I applied for her statements of bank charges prior to the big case going to court, however i did not know how to calculate the charges and i am still unsure, hence why its been left so long!. It may just be me trying to over complicate things...

do i just calculate EACH charge on the statement... there are different types of charges on the statesments and i am unsure... i have noted these as follows:...
    1. type=fee and description = account charge.
    2. type=chg and description = o/draft interest
    3. type=chg and description = o/draft excess fee
    4. type=chg and description=unpaid d/d
    5.type=chg and description =transactions

i am trying to claim back for several accounts, so i then calculate the charges separately.?

OK account charge - charge for the type of account you hold - not claimable
    same with overdraft interest

    Claimable, o'draft excess & unpaid D/d

if your claim is due to financial hardship take a complaint to the Financial Ombudsman under reclaim of bank charges but be sure you emphasise your hardship case

Where a claim for bank charges has been 'Stayed' in the County Court, has anyone heard of an application being made to the County Court for bank charges imposed after the High Court Test Case was announced to be returned and none further to be imposed upon that bank account until after the outcome of the High Court Test Case is known ?

if RBS don't respond positively make a complaint to the Financial Ombudsman, make it on the grounds of reclaiming bank charges but REALLY emphasise your hardship case !!!!!

    Hi Tiggrae,

thank you for your help. To clarify, i can claim back on charges 3 and 4, but not on charges 1 and 2. what about charge number 5?
