Reclaim Unfair Bank Charges article discussion Part II

Hi Everyone,
Just a quickie :-)
I've not yet put in for my 6 years worth of charges, however I wrote to them last year complaining about one particular set of charges that had been applied that month that I wasn't happy with. They wrote back explaining about the test case and that my complaint was on hold etc etc. I wasn't putting in a claim as such just complaining about hose particular charges.
Anyhow, as they#ve responded in this way re those charges does this mean that should the test case go as we hope they will automatically give me back 6 years of charges or do I have to write and claim myself ?
Sorry to re-post but as this has gone back a page, I don't think it will be spotted.
Anyone know what I should do ? got hit with a load more charges today that sent me overdrawn, funny how they can allow that to pay themselves but not let me go overdrawn to pay the actual DD's0 -
A big thanks to MSE for all the advise found on you web site. My bank's solicitor has today confirmed the bank has agreed to refund my claim in full, every last penny of charges, court costs and interest and as this amounts to just over £5400 I had a very big smile on my face when I opened the letter this morning. So for all of those who are still claiming, stick with it and don't accept the banks letters telling you their charges are fair or if they make you an offer for less than you claimed, don't accept it, stick at it until you get the full amount, they seemed to get sick before I did, but be warned you will have to be prepared to write lots of letters, I have written about 10 letters to the bank, their solicitors and the courts but it has been worth it. And the bank was "sorry can not say ther made me sign a letter of secercy" but their name is mentioned in the bank charges reclaim song.

I have to say I am gobsmacked Congratulations on your success! but I am so confused, how strange this is, since we have all been told they are not paying out any claims til after the OFT case. I have followed the whole procedure, all the letters you mention, plus 200 x 3, pages of evidence in my court bundle and an hour in court, still my claim is stayed.0

Hi Paul1e,
am new to this so forgive me...
very reassuring to hear that HSBC are still paying out for unfair bank charges... I used the template on MSE to claim in July 2007 and received a bog standard letter back about how they're working with the OFT and no agreement has been reached blah blah blah. I chased them by letter a few months later and received a similar letter back. Plse can you provide any advice on what to do next - they owe me approx £1000 which I really need at the mo (to pay off debts which they've helped me incur due to charges etc!)
look forward to hearing from you...0 -

A friend of mine is in an IVA and would like to reclaim credit card and banks charges, can he do this or is it unwise?0

GO to MARTINs reclaim site and follow the template letters exactly, keep to the timetables, even if they are not paying out at the moment it will save time later on if you have everything in place.0

Hi there ,can anyone help me with this, I'm new to this game and dont know what to do next. I applied to barclays bank in July 2007 for copies of my son's charges, No problem ,Barclays sent them in August and even sent my cheque fo £10 back . I then sent them Martin's 2nd letter in September asking for all charges to be repaid. They acknowledged my letter on the 18th of September and said they believed the charges to be legal ,fair and transparent and would normally resolve my complaint through their internal complaints process, however with the proceedings with OFT going on they have asked the FSA to suspend all claims. They have said that once the proceedings are over they will deal with my complaint as soon as possible. I'm now stuck as what to do next ,do I wait for this to be over and for them to contact me as they've advised, or am I being too trusting and should be doing something in the meantime. They have said that if I choose to issue a claim in court they would apply to the court for an order to stay my action till everything is resolved.I don't want this to slip up at this stage so what do I do ,wait or get stuck in, Help please0

if I have registered myself with a debt company (CCCS for 2 years now & on a management plan) & all my credit card cards have now sold over to a debt recovery department, can i make a claim against the original credit card company for charges.><O:p></O:p>
<O:p></O:p>
I'm aware that i will have to pay the £10 charge for the statements, will they if I’m successful with the claim, re-open my account & reduce the debt? <O:p></O:p>
<O:p></O:p>
I also have a parachute account, should i use the cheque book on this account or Postal Order? <O:p></O:p>
<O:p></O:p>
I'm also aware that the OFT stated that charges should be £12 (after June 2006) & will be able to calculate the difference using Martin's link & template. <?xml:namespace prefix = v ns = "urn:schemas-microsoft-com:vml" /><v:shapetype class=inlineimg id=_x0000_t75 title="Stick Out Tongue" smilieid="5" stroked="f" filled="f" path="m@4@5l@4@11@9@11@9@5xe" alt="" src="http://img.moneysavingexpert.com/smilies/tongue.gif" border="0" o<img></v:shapetype>referrelative="t" o:spt="75" coordsize="21600,21600"><v:stroke joinstyle="miter"></v:stroke><v:formulas><v:f eqn="if lineDrawn pixelLineWidth 0"></v:f><v:f eqn="sum @0 1 0"></v:f><v:f eqn="sum 0 0 @1"></v:f><v:f eqn="prod @2 1 2"></v:f><v:f eqn="prod @3 21600 pixelWidth"></v:f><v:f eqn="prod @3 21600 pixelHeight"></v:f><v:f eqn="sum @0 0 1"></v:f><v:f eqn="prod @6 1 2"></v:f><v:f eqn="prod @7 21600 pixelWidth"></v:f><v:f eqn="sum @8 21600 0"></v:f><v:f eqn="prod @7 21600 pixelHeight"></v:f><v:f eqn="sum @10 21600 0"></v:f></v:formulas><V:path o:connecttype="rect" gradientshapeok="t" o:extrusionok="f"></V:path><v:imagedata o:title="0" src="file:///C:\Users\PETERR~1\AppData\Local\Temp\msohtmlclip1\01\clip_image001.gif"></v:imagedata>Thank you all in advance for your help<v:shape id=Picture_x0020_2 style="VISIBILITY: visible; WIDTH: 12pt; HEIGHT: 12pt; mso-wrap-style: square" type="#_x0000_t75" alt="0" o:spid="_x0000_i1025"> <v:imagedata o:title="0" src="file:///C:\Users\PETERR~1\AppData\Local\Temp\msohtmlclip1\01\clip_image002.gif"></v:imagedata></v:shape>:A <O:p></O:p>
