    Test case to be held behind closed doors! Well almost


    The OFT/BANKS test case is now due to start on the 16th January. As the Judge has requested two days as reading days. In addition the case It is now to be held in at the International Dispute Resolution Centre at 70 Fleet Street, EC4Y1EU and not at the High Court.


    There are only 11 places for press and public. Entry is going to be on a first come first serve basis but it will be divided equally between the public and press.

    Passes will be issued separately for morning and afternoon sessions. This will mean that it is going to be impossible for one person whether public or press to get the full picture of the case.

    A spokesman from the OFT is alleged to have said that he 'did not realise' the room was only big enough for very few members of the public.


    For those who didn't know the test case is taking place to decide whether banks charges are unlawful. If the OFT's case is successful it will result in the bank having to repay billions to millions of there customers.

    And remember this all began because Abbey national refused to refunded me £64.00 glad I not in their shoes.

    Back to business

    Today I have had a meeting with my local MP Mr Gary Street he agrees that the lack of seating for members of the public and the press is a disgrace. He will be raising a motion in parliament on Monday. We ask that all members contact their local MP's A.S.A.P (tonight & tomorrow email them phone them fax them) ask that they support MP Mr Gary Street in his motion.

    It is obvious that the OFT/bank are hoping that the case will receive little media attention and that it will just go away we must make sure that this doesn't happen the fight for fair banking may soon be over!!

    We've put up with excessive bank charges for too long but the straw that broke the camel's back was when our benefits were paid in a week late about 4/5 months ago as they were recalculating my DLA and all our Direct Debits bounced at a charge of £35 a go - totalling over £350. Now we're getting regularly charged around £200 a month (we've cancelled all but our essential DDs) because as fast as our money gets paid in, it's getting eaten up by charges which when you're only getting £250 a fortnight paid into the account is making life very hard financially for us. We've got in arrears on our mortgage as a result (the DWP only pay part of our interest each month leaving us to find over £400 towards it ourselves) and as we can't risk having a DD in place and getting charged £35 by the bank they are now charging us £15 for not having one in place plus a £50 charge for every month that we're over one month in arrears - although they have so far been quite sympathetic and it hasn't got to the stage where they've threatened repossession yet.)

    We've just received the list of charges for the previous 5 years and all statements for last year from Abbey and are about to start on the next stage but with a little trepidation to tell you the truth. (We have a £1500 overdraft at present so if they get narky we can't afford to pay it back.)

    Our charges are probably in the region of a few thousand pounds though (haven't totalled them all up yet) so we really need to go for it as that would repay the mortgage arrears and help us get back on track. Just looking for a little reassurance that we're doing the right thing in trying to reclaim them I think :D Can anyone advise if it is worth trying to claim interest on top of the charges and how the calculator works (having a blonde day today.)

    One question regarding bank charges.

    Why can you only reclaim 6 years worth of bank charges rather than all the bank charges incurred since you opened the account?
  • I was under the impression I cannot reclaim my bank charges.
    I'm getting so comfused.

    You need to clarify how they 'gave' this money. Was it a regular payment of some sort such as a Direct Debit or Standing Order?

    The money may have been requested by the originator if it was a DD.
    I have written quite a few letters to the Halifax every time they state I owe them money. I have stated that as far as I'm concerned I don't owe them a penny as they are at fault not me. Every letter seems to be ignored and they keep sending me reminder letters.

    Whether the money was paid to the utility company in error or not, you can still make a claim for bank charges. If the amount they are chasing you for is made up of bank charges, you can let them know the amount is under dispute and they should not keep hassling you about it. Let them know you will be starting a claim to reclaim them.

    Just a quickie :-)

    I've not yet put in for my 6 years worth of charges, however I wrote to them last year complaining about one particular set of charges that had been applied that month that I wasn't happy with. They wrote back explaining about the test case and that my complaint was on hold etc etc. I wasn't putting in a claim as such just complaining about hose particular charges.

    Anyhow, as they#ve responded in this way re those charges does this mean that should the test case go as we hope they will automatically give me back 6 years of charges or do I have to write and claim myself ?
  • Please can someone advise me. I have sent off 5 letters to Lloyds TSB regarding claiming back charges. I have just been charged AGAIN even though I have tried to call the bank for help as it is something out of my control. The more they charge me the more I am going overdrawn, they wont give me an overdraft because I have keep going overdrawn!

    In desperation I was going to hand deliver a letter on Friday when I got home from work with again all the copy letters that I have sent, and I have already paid the £10 admin fee yet I now think they owe me that back as well!!! What on earth can I do? my bank charges will probably be about £6000 at this rate!

    I am at my wits end!

    What if I'm too late? my first letter was back at the beginning of 2006!

    anyone else having this awful problem??
