    I think you'll find that's just his opinion, or his managers opinion. The advisors in the bank know no more than anyone else about the court case.

    (*Unless it's Santander. The branch says they sent you an umbrella 3 times already and don't understand why you don't have it yet and want it back right now!!!)
  • PLEEEEASE READ THIS My name is Rachel and I have just started reclaiming my bank charges. my bank, the Ulster Bank, acknowledges my request for statements and assures me they will follow. Meanwhile they have taken away my overdraft! I was also under the illusion that you cannot use your switch card unless you have the money to cover the transation, either over the counter or at an ATM, but recently my bank has been letting transaction go through then charging me. Are they allowed to do this?

  • I've had a claim running now since early last year. I was within days of getting a settlement, the bank hadn't filed a defence after 28 days so I asked for a judgement which the MCOL website rejected. The person I spoke to then told me to ask for a judgement using a downloadable form. I then wrote to them with this asking for a judgement and Barclays had somehow managed to file a defence after the 28 day deadline (what's the point of the deadline?). Does anyone know if this is correct / legal?

    Also I was going to use the money I was reclaiming to pay off my existing overdraft and close the account, since the stay in August I have incurred monthly account fees of £11.50 and interest of about £5 a month. Will this be refundable if the OFT case is successful?

    You are not alone its happened to most of us, I had Barclays file the defence after the deadline, no its not correct and if it was us we wouldn't get away with it, but the banks seem to be above the law. Its a conspiracy, the government, the OFT, FSA and FOS are all on the banks side, particularly the government they don't want to lose out, they could have put a stop to this long ago. !! my hearing was stayed,I objected and had an oral hearing to lift the stay, it was refused, we have been campaigning ever since. now we are fighting to be heard!!!
  • Haven't had the time to read through previous posts, just wanted to let you know that if you try to reclaim charges (as in maybe up to 100GBP of recent [within the last month or 2] charges as opposed to those wanting to add up 6 years worth of charges up to reclaim them) from HSBC just be polite and don't challenge the legality of the charges. As long as you haven't had refunds before (or too many that is) it is usually easy to get reversals as gestures of goodwill. But don't abuse it- they have one of the fairest charging policies and of course I can't offer any guarentees :) Hope this helps!
  • oh and of course if they dont agree to a refund they rarely mark that you asked on the system (unless you made an official complaint) (although all calls are recorded of course) so you can still try for the legal challenge.
  • I bank with First Trust and want to know if I can reclaim for being charges when using authorised overdraft. If I go into my overdraft at all, I am charged for EVERY transaction made in the quarter. Is this correct?

    Im a student in university who followed the advice on the web site and was successful reclaiming bank charges from Lloyds Bank. I was awarded £400 which I accepted but not long after this Lloyds removed my student overdraft from my account and collections started ringing me up saying I owed over £1300 which was my overdraft total after 400 was deducted form it and have been threatenging me with court action ever since. I have been on the phone numerous times to the bank explaining this was my overdraft which I cannot possibly start repaying until I finish university in the summer of 2009 but they dont seem to care. I have had letters saying they have put a mark against my name for future lendinf and I havnt got a clue what to do now, surely they cannot do this!   • What gets to me is that everything was going well.

    Then they step in and straight away let the banks freeze all outstanding cases until the mock trials completed

    While we wait the banks are still being allowed to continue to charge?

    I thought their reason for stoping any more payments was to see whether it was lawful to charge these rates or not?

    Yet they are still allowed to proceed in charging :confused:

    It's all wrong everything should of been stopped :mad:
