Reclaim Unfair Bank Charges article discussion Part II

A thought should banks win the test case.
Should they be allowed to charge unauthorized overdraft charges when there's no way to bring your bank account into credit?
e.g. If you go overdrawn on a Friday.
There's no way to deposit money to clear the unauthorized overdraft until Monday because the bank is not open (some branched do open on a Saturday, but mine doesn't) or there are no facilities to make a deposit via a cash machine.0 -

With some banks it doesn't matter even if they ARE open on a Sat.
Example: On Fri it shows account will go overdrawn on Monday due to DD or SO so Sat pay cash in (didn't have the cash on the Friday).
On the online banking it shows cash rec'd into account and enough credit for the DD or SO.
Monday the cash is not shown as not being paid in until Mon......wait for it.....AFTER the DD or SO has needed to be paid, so it is bounced and a £35.00 charge ensues, which of course they pay to themselves even though it would take you overdrawn (if you hadn't paid the cash in).
If you phone to query the reply is that "Sat is not a banking day for us"

I am new to the money saver site, I would like to start claiming back my bank charges from 4 years ago. My account was originally with the Woolwich, which has now been taken over by Barclays.
Can I still make a claim....Sorry if this question may have been asked before, but I did do a small search on the site beforehand.
Any assistance would be great.
Thanks
Yes you can, send off the letter to Barclays but if you had a different account number with the Woolwich then make sure you quote that number too.0 -
rakingston wrote: »Hi I wondered if anyone could help - I want to claim back bank charges and credit card charges - both of which are with nationwide. When requesting my last 6 years of charges can I do both at the same time as they are both with nationwide (and only pay one £10) . I realise that bank charges reclaim is on hold but can i still get these charges now so I can start the process and ensure that the last 6 years are taken into account. Thanks in advance for any advice. Richard
The SAR request, the first letter asking for your information/statements, should cover all accounts held by you at the Nationwide so put in the details of both your credit card and current account and enclose one £10 cheque. And yes get your claim started now.0 -
Please can anyone give me some advice please.
I requested information from halifax bank last year 24 april. I stated they had 40 days to reply, based on data protection law, but they sent me the reply 29 june 2007, over two months later. After which the test case was announced and a block put on any claims going in front of the court. I would like to know what the situation is now? Do you think a court will look into this based on the fact the bank took longer than the 40 days they were supposed to.0 -
I have to say I am gobsmacked Congratulations on your success! but I am so confused, how strange this is, since we have all been told they are not paying out any claims til after the OFT case. I have followed the whole procedure, all the letters you mention, plus 200 x 3, pages of evidence in my court bundle and an hour in court, still my claim is stayed.0
