This is a big thank to Martin & Particularly to EdinburghLass who has been helping me over the past few days.
Took the gamble to issue the warrant yesterday on MCOL (£55 cost). To my surprise the warrant has been issued today to A&L for £3654.50, so baring some act of god......

I was just about to go to court via MCOL regarding my claim for £2100 from Yorkshire Bank. Should i still do this in light of last weeks events? If i wait until the outcome of the test case, i stand to lose a substantial amount of money as alot of the charges where in late 2001/ early 2002 and i have sent the bank the standard letters and have had no reply from them to my last letter. Would be grateful of any advice.0

:eek: I have just had some very infuriating news through RBS customer relations unit in Edinburgh. My partner and I signed an offer received through the post on the 27/07/07 with a date of 19/07/07 on top. We signed and sent back on the same day for the figure plus we were asked to add any charges accrued to the bottom of this so it would be dealt with as one claim. I was told the money would be in within 10 working days.
They have now informed me that I will receive a letter within 3wks detailing what happens next!!! Even though I was told the money would be in within 10days!!! They are saying this has changed which I argued is a breach of an agreement. I phoned the FOS to clarify this and they said I am right with my information and that RBS are wrong. I phoned back RBS only to be told that the team leader has no comment to make and that she knows nothing of the FOS ruling told to me. I am raging. Can anyone Advise?? They were so unhelpful. Thankyou!

Well I received two letters from HSBC just after the deadline for them to enter a defence for the claim. One was to say that the defence had been entered and the other was to say they will pay the full amount I was claiming for without them admitting liability etc.
I decided to make them wait before I answered the letter.
Today, about a week or so later, I received a letter from the court stating:
It is ordered that the defence be struck out as an abuse of process. The claimant may enter judgment.
Cool.
I wonder what i do now? Enter a judgement with the court and get my money I suppose.0 -

I've gone ahead and used MCOL as i dont want to wait a year to claim through the courts. Its cost £120 but if we win it will be worth it.0 -

Im still awaiting to hear from my county court. Its been about a month now. Ive rung twice and and they said they would reply to me by end of next week. But since the OFT VS Banks have come up, I havent heard anything from the court. Is everything on hold at the moment? Please Help.0

I have two court dates already - both with Barclays.
Mine is 16th August - my husbands is be mid-October.
Are these court cases postponed or are they going ahead.
Really appreciate anyone in the know telling me!
