    I was claiming against HSBC, and will continue to do so,however they have been very clever in dragging out replies.If they had replied to deadlines I had set for them,I would be in the position of having had a refund.However they dragged this on and on.I spent 30 mins having a major argument with the so called HSBC service quality team at Leeds today.One lady at the end of the phone had the audacity to quote me "well we have 8 weeks to respond" to which I bit her head off saying "that HSBC had deliberatly span out the timescales and if they hadnt we wouldnt be having this conversation.

    Needless to say I have emailed HSBC as well as the FSA.The latter asking for the conditions they (fsa) have set for the banks to meet whilst the waiver is in place.

  • with regard to the OFT rulings/suspension on claims etc etc, my partner went to court today, Mon 30th July for £900 from HSBC and won the case. HSBC hadnt even bothered to post a defence, let alone turn up.We will see if they close her account or whatever but hope is not lost for everyone who hasnt got there yet.
  • Hi, after months of just being patient with my 2 banks, I decided to take them to court... The claim was classed as served on 24th July, I came home from holiday to the OFT news and just thought oh my god I have thrown away £240 on court costs! I checked MCOL and both LLoyds and Nationwide had filed an acknowledgement form! I was really annoyed, as I had been planning on taking them to court sooner just finding the court fees is a bit steep! Anyway yesterday I got a letter from Lloyds solicitor dated 26th July (They filed an acknowledgement on 25th July) offering me the full amount I had asked for + court costs! I am delighted and as the offer was made before the Friday from what I understand it still holds! The only think is they want to transfer it direvtly into my LLoyds account, and I didn't want them to do that as it will just get eaten up in the overdraft which I asume they will then instantly reduce! i have asked for them to pay it into a different account??? Not sure if they will! Anyway I claimed back £1300!

    Just waiting on Nationwide now, just wondering what will happen as the claim was served before the announcement, and they filed an acknowledgement before the announcement... fingers crossed as they owe me about £3400!

    Hi ,i have just received notice of Preliminary Hearin, the court letter actually says........ Take notice that the preliminary hearin will take place on sept 5th 2007 at 11:00 pm at .... county court ,10 minutes has been allowed for the preliminary hearin. please note ; this case may be released to another judge ,possibly at a different court............... can anyone tell me what this means ???? and do i need to send any paperwork to the court ???? do they require a court bundle at this stage ???? any info would be greatly appreciated thank you.

    A preliminary hearing is for the judge to decide if the case goes any further, there are likely to be a lot of similar cases held that day. Please read this thread...

    A court bundle won't be required at this stage but do have your list of charges etc with you.

    I too received an offer dated 26th July. (through FOS). By the looks of other posts, I should be ok. Here's hoping!!

  • I do not have details yet but I have sent an e-mail to the complaints department at the FOS. I have stated my claim and await a response.
    now that don't kill me, can only make me stronger.

    Right guys, got Judgement against A&L on the 18th July. Since then they have not replied.

    Just hand posted a letter in Leeds saying 14 days is over tomorrow and I will issue a warrant.

    I cant get on to MCOL (presume every ones trying) but am I doing the right thing. Can they put my judgement on hold.

  • I have been waiting for about 1 month now. Its in the court process but they still didnt send me the court allocation questionaire.. I have rung the county court twice and they said to expect the judges decision on how to proceed by end of last week. But then suddenly the OFT decided to take on the banks in High Court, does that mean my case will now be suspended pending an outcome in high court? If I ring them now will they tell me all the bank charge reclaims are on hold pending the outcome in High Court? I got an email from Martin saying that court cases can proceed as normal. Now i am confused.. But will the county court listen to me even if I said that it can proceed as normal.
