  • Hi, I have to put a court bundle together by 08/0807. doesnt leave me much time however I am to pay £100 court fee & if I have to pay even more for a court bundle which may not arrive in time this leaves me very short of cash. Barclays are saying I have not supplied a breakdown of charges even though I sent a list with every correspondence. I have sent barclays another list asking for a breakdown of their charges.
    WHAT IS EXACTLY IN A COURT BUNDLE???
    Should i send a list of charges to the court
    Also What should i do with the freeze on bank charges.
    Help!

    My court date is set for 22nd August and I had to get my bundle in by 20th June - then the HSBC had to send their defence 28 days later. This came and went and they didn't enter a defence, so I wrote to the court and asked them to give me a judgement. This letter would have arrived last Wednesday (just before the shock announcement about the OFT test case). I haven't heard anything so called them just now and was told that I have been given a judgement for the full amount that I was claiming (£5100) including interest. :j

    But... I can't help but feel nervous.

    Has anyone else received a judgement from the court and if so, did the bank pay up?

    Will the OFT test case mean that the bank can refuse to pay?

    The bank must pay up and if they haven't paid up within say 14 days (from the day of judgement) then you need to issue a warrant against them!

  • Received letter from NatWest offering me £377 on 16 July, which was basically what I asked for minus the interest. Sent back the form the same day and was looking forward to the money. After approximately 5 days I phoned and asked how long is this going to take and was told 10 - 14 days after the post mark of the letter. In my view this means 30 July (today) at the latest. Surprise surprise no money yet, so phoned again... what they told me absolutely stunned me:
    - they clam they only recieved my form last Friday
    - they are now going to send out new letters with information about the OFT case with a new form where I can again state what I want to do, this letter will be with me in 3 weeks (with NatWest this means it will be the last day of the 3rd week)
    - in the meantime they are not paying out.

    I tried to reason with them saying that I had accepted long before the whole OFT thing kicked off and that I now want MY money, they simply refused to discuss and pleaded ignorance - I can only tell you what I've been told.

    I'm not quite sure what to do, in my mind this is a simple case of NatWest (we use a different name for them at home ;) ) stalling payments. I should have been paid by today, but instead I'll have to wait 3 weeks for the letter and then probably another 3 weeks until they have processed payment.

    I hope anyone can tell me what to do for the best or hopefully Martin (money saving hero) can advise us all.

    Thanks everybody for all the helpful posts in the past, even though I've only registered with the forum today I've been following everybodies progress on the forums here for quite a while.

    I am in exactly the same position as you with NatWest!!!

    I had 2 offer letters one dated 12 and the other 13July the first for £483 (full amount of old closed account without interest) and the second for £132 for charges applied on my current account while they were dealing with my initial claim (which has been paid) for £464.

    I rang last Monday and was told that refunds are made 14 days after you return the acceptance letter to them - they would have got mine on the 16 or 17 July - so the 14 days is up tomorrow (will check my account then). The did take 14 days to repay my initial £464 claim!

    Anyway, I WOULD NOT WORRY TO MUCH AS NATWEST HAVE MADE A CLEAR UNDERTAKING ON THEIR WEBSITE www.natwest.com/overdraftchargesupdate THAT THEY WILL HONOUR ALL "FULL AND FINAL SETTLEMENT" OFFERS THAT HAVE ALREADY BEEN MADE!!!!

    We may however, require an extra amount of patience dealing with these robbers :rolleyes: :rolleyes: :rolleyes: :rolleyes:

    Hi Folks

    I received an offer letter from Natwest on the day I commenced MCOL proceedings (and paid out my £120!). I rang Natwest the same day and asked if I accepted the offer would they pay my court fees as well. They said no, so I continued with MCOL. Natwest are now defending (via Cobbetts).

    My question for you experts out there is: Now we have the TSO announcement, do you think Natwest would still honour their offer letter to me? I am still within the 8 week time-frame. Or do you think they will tell me to 'go away'! Although their original offer was £300 short of my claim it does seem rather attractive now!!

    Any advice would be appreciated.

    Hi All,
    My first post on this subject, I have read many of the posts, the current situation is very confusing, so the questions I have, are pretty much the same as a number of others.
    I began my claim on the 2nd April, followed all the procedures, finally having to go to the C.Court and begin procedures. My case was accepted and fee paid. Once again, BARCLAYS (delaying tactics all along) left it till the last moment to indicate a defence, the 28 days have begun, several questions I now pose!

    1. Will the case be subject to suspension, pending outcome?

    2. As with others, since instigating a claim, the bank has added further charges for the two months, is this right?

    3. I have indicated to the bank (BARCLAYS) that I expect charges to also be suspended, and also that I intend to further claim against the additional charges so far, can I do that?

    4. If this drags on, what are the implications, if charges continue to be applied, it could amount to a rediculous sum, can they do that???

    5. How long has this procedure been in in the offing?

    6. Why was there no indication of this event, apart from the usual leaking???

    7. Is this going to be one of those institutionalised carve ups at a high level?

    8. Smells of colusion at the same levels, many wealthys investors do not like to lose money???

    8. Is this the response of the Sherrif's men to Robin Hood (sic) (Martin Lewis)?

    9. Finally, if all of this ducking and diving by the banks has been a tactic to synchronise with the sudden ?? announcement, how long has this been going on behind closed doors?

    You'll find the link to the Court Bundle at CAG in Martin's article and the Checklist for Court Bundle thread is here...

    If the court has asked for a court bundle you need to do three copies of this, one for the court, one for the bank and one for yourself.

    You will hear from the court if the bank attempt to put a hold on your case and the court will give you further directions at that time but you need to be prepared to go to court for your due date.

    Just wonder if anyone has found anything out about "cases that involve financial hardship" as per the FSA guidelines which implies that somewher in the banking code there is something that says that banks have to help in these circumstances...ie they cannot do nothing in the waiver period.
    Can I find anything in the banking code of practice..???....it must be printed in invisible ink or encrypted so that only the banks can read it.
