Hi there,
Just after some advice,I am currently claiming from Abbey £4256, have claimed in the small claims dept and tomorrow was there last day to put in a defence, unfortunately today I recieved that defence from them and so it looks like it is going to court. They have already offered me £795 which I declined but which they have since put into my account regardless, am i right tobe starting to panic or is this them justtrying to scare me???, has anyone else been in similar cirucmstances and had success???0 -
I Have had my claim in with Lloyds since January. I also had a payment of £750 from them in April. I accepted their offer without prejudice and continued with court proceedings. unfortunately for us we arent due in court until the 14th of August, so dont think we'll get any were as the bank will probably put in a stay.Hope this helps. Sara
Sorry forgot to mention they have also put in a defence.
I phoned them on Monday and they said that they were not prepared to settle out of court. Think they'll hang on till the last minute incase something happens with the test case!0 -

i have received a letter 3 weeks ago from lloyds solicitors asking for detailed breakdown of charges etc, also in the same letter they say they are minded to enter into settlement negotioation without admiting liability and without prejudice, i sent all the info back the same day and gave them 7 days to respond! i have heard nothing since!
in light of current situation can anyone tell me what may happen now, and what should i do?
kind Regards

hello everyone
i am new to this forum but have been trying to reclaim bank charges from the abbey for a couple of months. i am claiming for £3211.47 inclusive of interest. they offered £783 as a goodwill gesture which they are going to put into my account in the next 10 days. i am not satisfied with this outcome. what should i do now?0 -
My on line case at Northampton court was not acknowledged be Halifax Plc so i asked the court to enter judgement, they have rejected my claim and say i can take no further action on line. Halifax had offered me £700 of My £1200+ claim out of court which i had declined can i take any further action0

Your claim will now go to your local court and you will hear from them next with a court date and/or further directions.0

Hi,
I am currently in the process of claiming online and the bank has stated it intends to defend all of the claim.
I have paid £120 towards the online claim however i am very concerned as to how much it will cost if i was to lose the claim. I do not wish to end up with a large bill for court costs.
please advise?
I did a claim on MCOL and paid £120 fee. My claim was then defended and sent to my local County Court - I got a letter from them and had to pay a £100 allocation fee within 7 days or my case was being thrown out. Luckily I did have the £100 - but I think it's important that people realise that if their claim goes from MCOL to the County Court then there is another fee to pay, I imagine that people in financial hardship would find it difficult to get £100 together in 7 days and thus have their case thrown out.0 -
I have submitted a court claim (hours before announcement) have already received an offer from hsbc of £1700 which i accepted. They then ignored all my replies to their offer and subsequent phone calls/letters etc. thereby leaving me with no option to go down the bank route.... Will the court still postpone judgement depending the result of the test case or does it depend on individual judges?0

Hi
I am after advice too. I am trying to claim £415.00 from Halifax - started before this latest trail court news. Initially got told by Halifax charges were unlawful - as expected by reading the guide on the website - so sent the next letter threatening action. The 14 days to respond to that was this monday and I haven't heard anything from them - now obviously with the latest happenings - I don't know how to pursue this or whether to just wait. Is £415.00 worth going to court for and how much could I lose in court fees? Any advice and has anyone been successful with Halifax claims?
Thanks!0
