Just been looking at the HSBC website (they have an official statement re the OFT announcement) and it states that they believe a decision to the test case is not expected before a year. They also say that if anybody attempts to start court proceedings against them, they will apply to the court to hold the action until the result of the case is known.

Forget that. My court has just thrown out HSBC's defence due to an abuse of process by them. cool

Thats good news for you however I assume your case was already in the system where the news on the HSBC website relates to new cases, not all bad news though, everyone should read of Martin's Emergency Guide and then you can make up your mind if you wish to start a claim..

  • Hi

My bank bounced three different payments last month. The amounts were higher than the £38 they have charged me on two occasions - £50, £24.99, £165). On the other hand, they didn't pay the charge at all, just sent me a lovely letter instead. So can I claim because this is in effect a penalty? Or not, because there was no disproportion and the fee was lower than the charge.

I'm sure this is answered already in several other places, however I'm a bit nervous and stressed about even contemplating tackling the 'Almighty Bank' to find it...

    Hope you can help

Sorry Angela, its late and I haven't a clue what you mean, but yes you can claim them! If these are first time charges you would be as well phoning the bank and asking, if not then read Martin's article here..

Once you have the money in your bank then email MCOL and say your claim has now been settled and would they please close your claim.

    Hi ebl,
This is just a note to say thank you ALL for your help in trying to claim charges. It has come to the point that i am too ill to carry on the process of claiming. I have been trying since march and it has now got to much.
I wish EVERYONE the very best of luck for the future, and may all your worries be little ones.
    Thank you once again,
    John

Hi im hoping someone can help us, we have been claiming £4000 from barclays since january. We have got to the court stage and we are waiting for a court date. Because of the announcement we decided to phone the court and ask what was happening. The lady told us the court viewed our case on 25/07/07 and a court date had been sent out to us. Will we still get this court date or do you think it will be stopped. We are so worried we are totally reliant on this money and we wish we had accepted the offer of £2300 but this was now over 8 weeks ago, is it worth asking the bank if they will still honour this offer or do you think they will tell us where to go.
  • Hi, I wonder if anyone can answer my question.
I have read the article on what to do with an existing offer in view of the latest announcement.
However, 3-4 weeks ago HSBC made me an offer of £613 on a £721 claim, and because I had been paid 100% (£390) on another HSBC account, I declined this offer saying I was looking for 100% pay out again.
My question is, will the whole thing go on hold now, or has it reached a stage where it will be paid one way or other.
I would gladly accept the original offer of £613 if it means receiving the money now and not having to wait a year... but don't know if I can back track now !
    Cheers

    Hi there,

Thank god i've already got by Bank Account charges back, just waiting on my credit card ones.

I've heard from Sainsburys Bank who i'm claiming £440 back from, they are offering me 50% of my claim and not sure whether or not to accept.

Worried that if i decline and go for the full amount, the same thing may happen to credit card claims as has to bank account claims and i'll therefore get sod all!!!!!!

    Any help greatfully accepted.

    Thanks again
